Abstract

Namen diplomskega dela je opredeliti, razčleniti, definirati razgovor z otroci, kadar preiskujemo kazniva dejanja. Dotaknili se bomo značilnosti razvojnih faz, ki sta jih opredelila Piaget in Kohlberg. Otroci so v dobi odraščanja v procesu fizičnega, psihološkega, čustvenega razvoja, kar je vsekakor pomemben faktor pri tem, kako dojemajo svet okoli sebe in dogodke, katerih so priče ali pa celo žrtve. Kako prepoznati znake, ki nakazujejo na to, da se z otrokom mogoče dogaja kaj nedopustnega, kaznivega? S pravilno tehniko vodenja razgovora oz. intervjuvanja je treba otroku pomagati posredovati dejstva in točne informacije za ocenitev dejanskih okoliščin. Otroci na svojstven način komunicirajo z okolico in če ga ta ne razume, bo svojo stisko kazal s svojim vedenjem, glede na starost in fazo razvoja. Kako voditi razgovor, da ugotovimo ali otrok govori resnico ali laže? Ali dejansko opisuje kaj se je zgodilo ali le odgovarja na naša sugestivna vprašanja? Odgovornost preiskovalcev in njihova usposobljenost intervjuvanja otrok je še kako pomembna. So zelo pomemben sogovornik in od njihovega odnosa je odvisno ali bo otrok spregovoril ali pa se bo zavil v molk. Pa še nekaj znakov, vidnih na otroškem obnašanju, telesu, ki lahko jasno kažejo, da je otrok v stiski, ker je žrtev KD.

Secondary abstract: The purpose of my thesis is to define and analyze the interview with children, where the offences are under investigation. We'll explain all the characteristics of the development phases identified by Piaget and Kohlberg. When growing up children are in the process of physical, psychological and emotional development, which is certainly an important factor which shows how they perceive the world around themselves and the events which they witnesses or they might even be the victims of them. But how can we identify the signs that indicate that the children might be involved in the crime? With the proper technique of interviewing the child it is possible to help forward the facts and accurate information for assessing the factual circumstances. Children communicate on a specific way with the surroundings and if they are not understood they will certainly show that with their behaviours, depending on the age and stage of development. How to keep the interview to determine whether a child is telling the truth or not? Or actually just describes what has happened or only responds to our sugestive questions? The responsibility of the investigators and their capacity of interviewing children is very important. They are very important interlocutor and their behaviour shows whether the child will speak or wrap in silence. However there are some characteristics, visible in child's behaviour and their body, which can clearly show that a child must be in distress, whereas it is the victim of an offence.
