Abstract

Tema magistrskega dela z naslovom Pravni vidiki psihičnega nasilja na delovnem mestu je bila izbrana na osnovi dejstva, da se vsak dan vse preveč ljudi po vsem svetu na svojem delovnem mestu srečuje s psihičnim nasiljem. Sodoben način življenja, globalizacija in vse večja konkurenca ustvarjajo dobre pogoje zanj. Predpostavljamo, da se zaposleni, ki se srečajo s psihičnim nasiljem na delovnem mestu, sploh ne zavedajo posledic, ki jih lahko povzroči tako nasilje. Cilj naloge je ugotoviti, koliko je psihičnega nasilja v slovenskih podjetjih, kako dobro ga anketiranci poznajo in ali ti poznajo svoje pravice, ki jim pripadajo s pravnega vidika. Naloga je sestavljena iz teoretičnega in raziskovalnega dela. V prvem delu smo na podlagi obstoječe literature predstavili najpomembnejše in najpogostejše značilnosti psihičnega nasilja na delovnem mestu ter pregledali slovensko zakonodajo, ki je namenjena preprečevanju in iskanju pravice po pravni poti. Drugi del je bil namenjen raziskavi, ki je bila opravljena s pomočjo anonimne ankete in anketirancem poslana na elektronske naslove. Z njihovo pomočjo smo pridobili rezultate, s katerimi bomo analizirali odgovore in potrdili oziroma ovrgli zastavljene hipoteze. V zaključnem delu smo glavne ugotovitve raziskave še dodatno analizirali in predstavili možne predloge za izboljšanje trenutnega stanja.

Secondary abstract: Master thesis with title Legal aspects of psychical violence in the workplace was chosen on the basis of fact that more and more people face such violence in their workplace. Contemporary way of living, globalisation and competition have a largely effect on such violence. We assume that employees that face psychical violence are not aware of the consequences that can cause such violence. The aim of the thesis is to determine the quantity of psychical violence in Slovenian companies, how well the employees are familiar with it and if they know their legal rights. The thesis consists from theoretical part and practical part – research. In the first section was with a help of existing literature presented the most important and the most frequently types of psychical violence in the workplace. Besides that we also checked the Slovenian legislation that discusses the prevention of violence and legal proceedings. The second part involved a research that encompasses a survey which was sent to the employees to their emails. Based on their responses the results were obtained with which given hypothesis were either accepted or rejected. In the final part findings of the survey were additionally analyzed and the proposals to improve the current situation from the field of psychical violence were presented.
