Abstract

Ponarejanje je oblika organiziranega kriminala brez pravih pravnih posledic. Vsi ponarejevalci imajo nekaj skupnega, to je kršitev zakona o intelektualni lastnini. Ilegalna reprodukcija ne zahteva dragih in zapletenih proizvodnih postopkov, ob odkritju pa so kazni mile in v večini primerov celo neizrečene. Ponarejeni kosi blagovnih znamk višjega cenovnega razreda so stalnica modne industrije. Potrošnikom dajejo občutek nezaupanja, povzročijo pa lahko tudi resne zdravstvene težave in posledice, saj izdelki niso laboratorijsko preizkušeni in lahko vsebujejo zdravju škodljive snovi. Lastnikom blagovnih znamk ponaredki zmanjšujejo vrednost njihovih izdelkov in omejujejo obseg prodaje. Z ekonomskega vidika so pravice intelektualne lastnine zelo pomembne, saj vplivajo na konkurenčnost subjektov na trgu, nove možnosti širjenja gospodarstva in dolgoročni razvoj, investicije ter raziskave. Z vse večjo uporabo interneta se ponudba in povpraševanje po ponarejenih izdelkih bliskovito širita. Posledica tega je vsakoletna rast števila carinsko zaseženih kosov ponarejenega blaga. Evropska komisija opisuje stanje kršitev intelektualne lastnine kot resen problem, katerega razsežnosti so gigantske. Kupna moč državljanov EU se je med gospodarsko krizo močno zmanjšala, kar je aktualiziralo problematiko kršitve zlorabe blagovnih znamk, kršitve patentov ter kršitve avtorskih pravic. Večina ponarejenih izdelkov vstopi v Slovenijo prek koprskega pristanišča. Gre predvsem za izdelke kitajskega porekla, ki so namenjeni slovenskemu trgu ali pa pot nadaljujejo prek Slovenije v druge države EU (Avstrijo, Madžarsko, Češko, Slovaško) ali v Srbijo ter Bosno in Hercegovino. V raziskovalnem delu analiziramo mnenje o odnosu do nakupa ponaredkov blagovnih znamk višjega cenovnega razreda in pogled pooblaščenih ponudnikov izdelkov blagovnih znamk na problematiko ponarejanja v Sloveniji. Ugotovitve apliciramo na slovenski trg ter predlagamo rešitve na represivnem in preventivnem področju.

Secondary abstract: Counterfeiting is a form of organized crime without formal consequences. All counterfeiters have one thing in common - breaching the intellectual property law. Illegal copying does not require expensive and complicated manufacturing processes. When discovered, penalties are mild and in most cases not even imposed. Forged pieces of prestigious brands are common in fashion industry. They create a sense of mistrust in consumers and can even cause serious health problems and consequences since they are not laboratory tested and can contain harmful substances. For brand holders counterfeited goods lower the value of their products and decrease their sales. From economical point of view intellectual property rights are very important since they influence competitiveness, expansion potential of the economy, long term development, investment and research. Broad use of internet is resulting in rapid expansion of supply and demand for counterfeit goods. As a consequence, number of seized counterfeit goods by the customs increases every year. The European commission describes the issue of intellectual property rights violation as a very serious one having gigantic proportions. Purchasing power of EU citizens has significantly decreased during economic crisis which has put the issue of brand misuse, patent infringement and violation of intellectual property rights. The Slovenian entry point for most of the counterfeit goods is Koper port. These products are predominantly of Chinese origin and are intended either for Slovenian market or transit to other EU countries (Austria, Hungary, Czech Republic, Slovakia), Serbia or Bosnia and Herzegovina. In the research part of this thesis we are analyzing the attitude towards purchasing counterfeit products of prestigious brands and perception of counterfeit issue in Slovenian market by accredited suppliers of original brand products. We are applying our findings to Slovenian market and propose solutions in repressive and preventive field.
