Abstract

V civilno pravdnem postopku gre za razrešitev posamezne vrste civilnega spora, kjer sodišče meritorno odloči o spornem pravnem razmerju med strankami v postopku ali o sporni pravici. Magistrska naloga predstavlja bistvene značilnosti civilno pravdnega postopka skozi prizmo delovanja detektivov, ki v ta namen pridobivajo dokazna sredstva. Na podlagi analize virov, intervjujev in sodne prakse je bilo ugotovljeno, da detektivi s svojo usposobljenostjo in zakonitostjo delovanja na področju civilno pravdnih postopkov svojim naročnikom olajšajo pot k uspehu v postopku pred sodiščem. Z verodostojnimi dokaznimi sredstvi, ki so nemalokrat lahko ključni element, lahko vplivajo na potek posameznega postopka. Za pridobivanje dokaznih sredstev uporabljajo različne metode in taktike. V Republiki Sloveniji je sodelovanje detektivov z odvetniki redko, saj se najpogosteje detektive vključi v postopek, ko v zadevi ni razpoložljivih dokaznih sredstev. Vloga detektivov na področju civilno pravdnega postopka za potrebe njihovih naročnikov, je v Sloveniji po mnenju detektivov še relativno nerazvita in v nekaterih konkretnih zadevah še nejasna. Detektivi se s svojimi prizadevanji že dalj časa neuspešno trudijo pridobiti konkretnejša vsebinsko dodeljena upravičenja, ki bi jim olajšala delovanje za potrebe svojih naročnikov. Prav tako so pri zastopanju stranke v vlogi pooblaščenca na sodišču omejeni z vlaganjem izrednih pravnih sredstev. Vzajemno sodelovanje odvetnikov in detektivov zagotovo predstavlja idealno kombinacijo za strankino dobrobit v postopku in bi ji bilo potrebno v prihodnosti nameniti večjo pozornost. Specializacija detektivov na področju civilno pravdnega postopka, lahko pomeni za detektive tržno nišo, vsaj glede na statistične podatke o številu zadev v civilno pravdnih postopkih na sodiščih.

Secondary abstract: Civil proceedings are led to resolve individual types of civil disputes, where the court decides on a disputed legal relationship or a contested legal right on the basis of merit. This thesis describes the key elements of civil proceedings from the perspective of the activity of detectives, who collect evidence to be used in the proceedings. Based on an analysis of sources, interviews and legal practice, it has been found that detectives can help their clients reach the desired outcome in court with competence and activity within legal limits. Credible evidence, which is often the key element in court proceedings, can affect the outcome of cases. Different methods and tactics are used to gather evidence. In the Republic of Slovenia the cooperation between detectives and lawyers is rare, as detectives are most often involved in the process, when there is a lack of evidence in a case. The role of detectives in the area of civil proceedings for the needs of their clients is still relatively underdeveloped and in certain concrete cases unclear. Detectives have been trying to obtain more clearly defined powers, which would facilitate work on the behalf of their clients. Their role in representing the client as authorised representatives is also limited to extraordinary legal remedies. The cooperation between lawyers and detectives is certainly the ideal combination for achieving the client's goals in the proceedings and should receive more attention in the future. The specialisation of detectives for civil proceedings can be a lucrative market niche, at least judging by statistical data on the number of civil proceedings before courts.
