Abstract
Diplomska naloga je razdeljena na osem poglavij, od tega predzadnje poglavje predstavlja uporabljene vire, zadnje pa vsebuje priloge. V prilogah sta intervjuja s kriminalistom ter sodnikom, ki sta bila uporabljena kot pomoč pri izdelavi diplomske naloge.
Na začetku diplomske naloge se srečamo z nekaj uvodnimi besedami, navedene so tudi hipoteze, ki smo jih nato na koncu, glede na ugotovitve, potrdili oz. zavrnili (natančneje povedano so tri hipoteze potrjene, ena pa delno potrjena). V nadaljevanju je predstavljen molk kot strategija obrambe, ki je tudi osrednja tema diplomske naloge. Z nekaj besedami so opisane obramba na splošno ter tipične strategije obrambe, s katerimi se posameznik brani v predkazenskem in tudi kazenskem postopku. Ker v literaturi molk ni štet med tipične strategije obrambe, je predstavljen posebej, v naslednjem podpoglavju. Predstavljeno je tudi stališče o tem, zakaj bi se molk lahko štel med tipične strategije obrambe. V tretjem poglavju se srečamo z interakcijsko situacijo, kjer se soočita nasprotni stranki (kriminalist − osumljenec, sodišče − obdolženec). Gre za razgovor in zaslišanje, ki ju s pomočjo podpoglavij nekoliko razširimo. Sledi poglavje Sodne prakse o pravici do molka, kjer so s pomočjo primerov predstavljene sodne prakse v ZDA, ESČP in Sloveniji. V naslednjem poglavju smo prikazali svoje ugotovitve, s pomočjo hipotez postavljenih na začetku dela. Šesto poglavje je zaključek, kjer je napisano lastno mnenje o temi oz. nekaj ključnih ugotovitev.

The diploma is divided into eight chapters. In the last two chapters are presented resources and annexes. The annexes are interviews with criminal investigator and judge, which have been used as an aid in the production of the diploma.
At the beginning of diploma, we meet with a few introduction words and hypotheses, which are then at the end, according to the findings, confirm or rejected (more precisely: the three hypotheses are confirmed and one partially confirmed). The following chapter is a silence as a defense strategy, which is also the focus of the diploma. With a few words are described the defense in general, and typical defense strategies in pre-trial and criminal proceeding. In the literature silence is not counted as a typical defense strategy because of that it is presented separately in the next subsection. It is also presented why can be silence considered as a typical defense strategy. In the third chapter we meet with the situation where confront the contrary clients. The interview and examination are expanded by using sub. Following chapter is focused on court practice about the right to silence. The court practice is presented with examples from United States, ECHR and Slovenia. In the next section we demonstrate their findings with the help of hypotheses set at the beginning of the work. The sixth chapter is the conclusion, where is written our own opinion about the theme and some key findings. |
