Abstract
V magistrskem delu smo predstavili osebne podatke in Zakon o varstvu osebnih podatkov. Prav tako pa smo tudi opisali zgodovino varstva osebnih podatkov pacientov. Dodali smo tudi pravne vire, v katerih najdemo določbe o varovanju osebnih pacientovih podatkov. Namen raziskave je ugotoviti, v kolikšni meri so člani tima zdravstvene nege, v zdravstveni ustanovi seznanjeni z varovanjem osebnih podatkov pacientov in v kolikšni meri se varovanje osebnih podatkov v praksi uporablja.
Metodologija raziskovanja. Uporabljena je bila kvantitativna metodologija. Podatke smo zbrali z anketnim vprašalnikom, ki je vseboval 15 vprašanj odprtega in zaprtega tipa. V raziskavo je bilo vključenih 66 anketirancev zaposlenih v Zdravstvenem domu. Rezultate ankete smo obdelali s pomočjo računalniških programov Microsoft Office Word 2007 in Microsoft Office Excel 2007 ter IBM SPSS Statistics 19.
Rezultati raziskave. Analiza dobljenih rezultatov je pokazala, da člani tima zdravstvene nege poznajo osebne podatke. Vedo, da je posredovanje pacientovih podatkov o njegovem zdravstvenem stanju le domena zdravnika. Seznanjeni so s kazensko odgovornostjo, kadar prelomijo načelo molčečnosti, in vedo tudi, da jih poklicne skrivnosti oz. molčečnosti lahko razreši sam pacient in sodišče.
Sklep. Iz raziskave je razvidno, da člani tima zdravstvene nege poznajo zakonske določbe glede varovanja osebnih podatkov pacientov. Vendar pa kljub temu še vedno prihaja do nepravilnosti in kršitev, ki pa jih člani tima zdravstvene nege med svojim delom opažajo. Te nepravilnosti so, da osebni podatki pacientov oz. njihove kartoteke niso zaklenjene. Kartoteke so shranjene na hodniku in prosto dostopne komurkoli. Prav tako se zdravstveno osebje pogovarja s pacientom o njegovih težavah kar na hodniku pred ostalimi pacienti in mimoidočimi.

Protection of personal data in nursing care |
Secondary abstract: |
In this master thesis we have presented personal data and the Law of personal data protection. We have also described the history of the patient's personal data protection. The legal sources have been added, in which the regulations about the patient's personal data protection can be found. The purpose of the research is to establish the extent to which members of the team of nursing care in a medical institution are familiar with the patient's personal data protection and to extent to which personal data protection is used in practice.
Methodology of research. Quantitative methodology was used with the open method of gathering data using a questionnaire containing 15 questions (opened and closed type). 66 respondents from the Medical Center have been included. The results of questionary have been treated with computer programs Microsoft Office Word 2007, Microsoft Office Excel 2007 and IBM SPSS Statistics 19.
The results of the research. The analysis of the gained results have indicated that members of the team of the nursing care are familiar with the personal data. They know that only a doctor has a domain of giving patient's data about his state of health. They have been informed about the legal liability if they break the principle of discretion and they have been aware of the fact that only the patient himself or the court can release them from the oath of the professional secrecy.
Conclusion. It has been shown from the research that the members of the nursing care team are familiar with the statutory provisions concerning the patient's personal data protection. However in spite of all this anomaly and violations take place, which are detected by the members of nursing care team during their work. These anomalies have been: personal data of the patients and their files have not been preserved properly and have been kept in the hallway, easily accessible to anybody, or that nurses have been talking with the patient about his problems in the hallway in front of other patients or passers-by. |
