Abstract

Pacientova pravica do odločanja o sebi spada v eno izmed zakonsko določenih pravic pacienta po ZpacP ter predstavlja eno najpomembnejših etičnih načel medicinske etike. Omenjena pravica daje pacientu možnost odločanja o sebi, kakšno oskrbo dovoljuje in kakšno ne. Ta pravica poudarja avtonomijo volje pacienta in njegovo aktivnost pri skrbi za svoje zdravje. Pacientova samostojnost pa ima poleg etične tudi pravno podlago, saj URS v 51. členu določa, da nikogar ni mogoče prisiliti v zdravljenje, razen v primerih, ki jih posebej določa zakon. Takšni zakonsko dopustni primeri prisilnega zdravljenja, kot je na primer obvezno cepljenje, ukrep osamitve ali karantene, prisilna hospitalizacija duševnih bolnikov in drugi, ščitijo zdravje in življenje drugih ljudi. Naloga je osredotočena na predstavitev pomena pravice do samoodločbe in njenih predpostavk. Govori o omejitvah in izjemah pravice ter o pravni ureditvi v Sloveniji. Diplomsko delo je namenjeno predvsem posameznikom, ki si želijo izvedeti več o samem pomenu pravice ter njenemu uveljavljanju.

Secondary abstract: The patient's right to self-determination is one of the statutory rights under the Patient Rights Act and represents one of the most important ethical principles of medical ethics. This right gives a patient the right to decide what care he or she allows and what he or she does not. The right emphasizes the patient's autonomy and pro-activity in personal health care. However, the patients' independence, in addition to the ethical basis, also bears a legal basis, as the Constitution of the Republic of Slovenia states that no one can be forced into accepting treatment, except in cases explicitly determined by the law. Such legally permissible cases of involuntary treatment, such as compulsory vaccination, solitary confinement or quarantine, involuntary hospitalization of the mentally ill, etc., protect the health and lives of others. The paper focuses on presenting the scope and content requirements of the right to self-determination, and its limitations. It is focused on restrictions and exceptions to the law and the legal system in Slovenia, in general. The diploma thesis is intended primarily for individuals who want to learn more about the very meaning of the right and its exercise.
