Abstract
Diplomsko delo obravnava uporabo prisilnih sredstev policistov na območju republik bivše Jugoslavije. Glavna pozornost je namenjena pogojem uporabe strelnega orožja kot najhujšega prisilnega sredstva v rokah policije ter njeni primerjalno-pravni ureditvi v Sloveniji in na območju republik bivše Jugoslavije. Policisti se pri svojem delu dnevno srečujejo z raznimi oblikami kriminala ter s storilci kaznivih dejanj od manjših prekrškarjev pa do težjih zločincev. Za uspešno izvedbo nalog in preprečevanje prekrškov in kaznivih dejanj pa morajo policisti velikokrat uporabiti prisilna sredstva, kot skrajno obliko prisilnega sredstva pa lahko uporabijo (v določenih primerih tudi morajo uporabiti) strelno orožje. Policisti imajo opravka z osebami, ki kršijo javni red in mir, cestno prometne predpise, se ne odzivajo na zakonite ukaze policistov, izvajajo kazniva dejanja, povzročajo materialno škodo, se izogibajo sodišču in sodnim obravnavam, bežijo s kraja kaznivega dejanja in se izmikajo pravnomočno izrečenim sodbam in kaznim, ogrožajo življenja ljudi itd. Da policisti preprečijo in raziščejo te kršitve in nezakonita dejanja oseb, pa lahko (kadar so z drugimi sredstvi neuspešni) uporabijo prisilna sredstva v skladu z zakonom in pravilniki.
Ker zakonodajalec daje policiji kot najbolj represivnemu organu zakonsko pravico do uporabe sile, še ne pomeni, da jo lahko policija uporabi kadarkoli, temveč samo takrat, ko je to nujno potrebno za uspešno izvršitev zadanih nalog in kadar imajo za to zakonsko podlago. V določenih primerih je uporaba prisilnega sredstva lahko nezakonita, nestrokovna, prekoračena ali celo zlorabljena, zato morajo policisti še posebej paziti, da do takšnih prekoračitev in zlorab ne prihaja, ker se s takimi dejanji manjša ugled policije med državljani, kar pa ima negativne posledice za javno varnost in stopnjo kriminalitete. V diplomski nalogi je poudarek na zakoniti uporabi sile, zatorej se s prekoračitvijo uporabe prisilnih sredstev in posledično pritožbami oškodovanih naloga ne ukvarja in jih ne analizira.

The diploma work treats usage of means of force by police officers in the region of republics in the former Yugoslavia. The main attention is focused on terms of firearms usage as the fiercest means of force in the hands of the police and the comparative–legal regulation in Slovenia and in the region of republics in the former Yugoslavia. Police officers daily meet various forms of crime as well as its actors, from minor offence to major criminal acts. In order to execute their work successfully and prevent minor to criminal offences, the police are often compelled to use means of force, and in the utmost situations, they are allowed to or even have to use firearms. Police officers have to deal with people who violate public law and order, disobey traffic regulations, do not respond to legal police orders, carry out criminal offences, cause material damage, avoid the court and its proceedings, escape from crime scene and evade final judgments and sentences, threat other people’s lives etc. Since legislator passes to the police, as the most repressive organ, a legal right to use force, that still does not mean that the police can use it whenever they want to, but only then when it is urgent in order to successfully execute the set tasks and when there is a legal foundation for it. In certain cases, the usage of means of force can be illegal, unprofessional, violated or even taken advantage of. Police officers have to pay special attention not to come across with such violation and misusage, since this lessens the police reputation among citizens and at the same time have negative consequences for public security and crime degree. In the diploma task, there is a great stress laid upon legal usage of force, that is why analyzing trespassing of means of force and consequently with complaints of anybody involved has not been dealt with. |
