Abstract
V magistrskem delu smo predstavili problematiko, s katero se srečujemo, ko želimo na letališčih s pomočjo sodobne tehnologije zagotoviti kar se da visoko stopnjo varnosti, ob tem pa trčimo v eno izmed najpomembnejših človekovih pravic in temeljnih svoboščin – pravico do zasebnosti. T. i. »telesni skenerji«, kot jih vidimo na letališčih, so v prvi fazi namenjeni varovanju naših življenj. Obenem pa imajo resen vpliv na zasebnost in varovanje podatkov. Za dokaz posegov v zasebnost smo se v magistrskem delu posluževali več različnih raziskovalnih metod. Med pogosteje uporabljene spadajo opisna metoda, metoda kompilacije in empirična metoda, poleg naštetih pa smo se poslužili še zgodovinske in deskriptivne metode ter metode analize podatkov in sinteze. Namen tega magistrskega dela je preučiti razvoj varnostnih ukrepov na eni strani in obseg pravice do zasebnosti na drugi strani. Cilj tega magistrskega dela je torej ugotoviti, ali je omejitev posameznikove pravice do zasebnosti sprejemljiva in pravno dopustna, da bi dosegli zagotovitev kar se da visoke stopnje javne varnosti. Ugotovitve predstavljene v tem delu bodo lahko v prihodnosti uporabljene tudi v sami stroki. Ta se bo lahko dodobra seznanila s pravnim vidikom problematike zasebnosti in telesnih skenerjev ter kateri predpisi jih omejujejo. Dodanih pa je tudi nekaj primerov možnosti varovanja javne varnosti, ki na področje zasebnosti ne bi posegali v tolikšni meri, kot to počnejo telesni skenerji.

In my final assignment, we have presented the problems we face when we want to ensure the highest possible level of security at airports with the help of modern technology, while colliding with the right to privacy. So called »body scanners« as we see them at airports are primarily designed to protect our lives. At the same time, they have a serious impact on privacy and data protection. We used different research methods. Most commonly used are the descriptive method, method of compilation and empirical method. In addition, we also used the historical, descriptive method and the methods of data analysis and synthesis. The purpose of this thesis is to examine the development of security measures on one hand and the scope of the right to privacy on the other. The aim of this assignment is therefore to determine whether the restriction of an individual's right to privacy is acceptable and legally permissible in order to achieve the highest possible level of public safety. The findings presented in this section may in the future be used in the profession itself. The latter will be well acquainted with the legal aspect of the issue of privacy and body scanners and what regulations restrict them. However, there is also added a few examples of the possibility of protecting public safety, which would not encroach on the area of privacy to the same extent as body scanners do. |
