Sprememba pogodbene cene v fazi gradnje objekta

Abstract

V diplomskem smo opisali proces priprave ponudbe in ponudbenega predračuna na področju javnega naročanja ter razloge, ki vplivajo na spremembo pogodbene cene v času gradnje objekta. Pravna in gradbena praksa sta za različne primere izoblikovali načine reševanja sprememb na pogodbah, ki smo jih v diplomskem delu tudi predstavili. Med številnimi izzivi je trenutno zagotovo najbolj aktualen poiskati uravnoteženo rešitev za spremembo pogodbene cene zaradi nepredvidene rasti cen na trgu. V diplomskem delu smo v ta namen opisali različne metode izračuna razlik v ceni storitev pri gradnji objektov ter predstavili njihove prednosti in slabosti. Dve opisani metodi sta uporabljeni na praktičnem primeru javnega naročila za izgradnjo kanalizacije. Izračun valorizacije je izveden z računsko metodo izračuna indeksa razlik v ceni, ki temelji na dejanskih stroških, in s pomočjo metode določanja razlike v ceni z indeksi GZS ZGIGM. Rezultate izračuna po obeh metodah smo primerjali ter jih v diskusiji natančneje povzeli in komentirali.

Secondary title:	Amendments to the contract price during the construction phase
Secondary abstract:	In the diploma thesis we described the process of preparation of offers and bid quotations in the field of public procurement, as well as the factors that lead to amendments to the contract price during the construction of a building. The diploma thesis also presents the methods of dealing with amendments to contracts, that were developed within legal and construction practices for different cases. Among the many challenges that the sector faces, currently the most significant one is finding a balanced solution for the amendment of contract prices in relation to unforeseen price increases on the market. To this end, the diploma thesis examines different methods for calculating price differences of services pertaining to the construction of buildings and presents their strengths and weaknesses. Two of the described methods were applied to a practical example of a public contract for the construction of a sewage system. The valuation calculation was performed by using a calculation method involving the calculation of the price difference index, which is based on actual costs incurred, and the method for determining the price difference by applying the indexes of the Chamber of Construction and Building Material Industry of the Chamber of Commerce and Industry of Slovenia. We compared the results of the calculations obtained through both methods and provided a more detailed summary and comment in the discussion.
