Abstract
V diplomskem delu je predstavljen postopek prodaje kmetijskega zemljišča. Kmetijska zemljišča (tudi gozdovi in kmetije) uživajo v slovenski zakonodaji zaščiten status. Promet, med katerega spada tudi prodaja, je posebej urejen s področnim zakonom – Zakon o kmetijskih zemljiščih. Potreba po državnem nadzorstvu pri razpolaganju s kmetijskimi zemljišči izhaja iz potrebe po ohranjanju, zagotavljanju in izboljševanju pridelovalnega potenciala takih rodovitnih zemljišč z vidika nemotenega procesa pridelave hrane ter ohranjanja krajine. Zakonske omejitve pri prodaji kmetijskega zemljišča, pri katerem izstopa predvsem institut predkupne pravice, težijo k zavarovanju obstoja in nadaljevanju namenske rabe takih zemljišč. Prednostne omejitve iz naslova predkupne pravice tako izhajajo iz različnih zakonodajnih področij, ki urejajo ohranjanje narave, urejanje prostora, gozdove in vode. Namen diplomskega dela je predstaviti celoten potek in dejanja v postopku prodaje kmetijskega zemljišča, to je podaja in sprejem ponudbe, upoštevanje predkupnih upravičencev in uveljavljanje predkupne pravice, odobritev pravnega posla s strani Upravne enote, sestava pogodbe s priskrbo vse potrebne dokumentacije, predložitev v odmero davka, overitev zemljiškoknjižnega dovolila ter vpis v zemljiško knjigo. Delo obsega tudi predstavitev posebnosti pri prodaji z vidika uveljavljanja predkupne pravice ter praks izigravanja zakona – izogibanje (npr. nerealni zakup) in izkoriščanje zakona (plačilo v zameno za umik uveljavljanja predkupne pravice).

This paper presents the farmland sales process. In the Slovenian law, farmlands (including forests and farms) have a protected status. Trade, encompassing sales, is regulated by a sectoral law – the Agricultural Land Act. The need for national control of farmland management stems from the need for preserving, ensuring and improving the production potential of fertile land, aiming at undisturbed food production and landscape conservation. The purpose of legal restrictions in farmland sales, mainly the pre-emptive right, is to protect and ensure continuous use of such land. The main restrictions in terms of the pre-emptive right are taken from different legal fields regulating nature preservation as well as area, forest and water management. The aim of this paper is to present the entire farmland sales process and related steps, namely making and accepting an offer, considering those with the pre-emptive right and exercising the pre-emptive right, gaining approval of a legal transaction from the administrative unit, drawing up a contract and providing required documentation, submitting papers for tax assessment, certifying the land registration permit and completing the land registration process. The paper also presents particularities of sales when it comes to exercising the pre-emptive right and law circumvention practices – avoidance (for example, unrealistic leasehold) and abuse of the law (payment in return for withdrawal of those with the pre-emptive right). |
