Abstract

Priznanje je širok pojem, do katerega ne pridemo zlahka, saj vsak osumljenec želi svoje dejanje prikriti z namenom, da ga ne bi doletela kazen. V informativnem razgovoru želi kriminalist priti do priznanja, osumljeni pa ravno nasprotno. Oba subjekta pri tem uporabljata tehnike in strategije, pri čemer mora kriminalist paziti, da uporablja le dopustne metode, saj v nasprotnem primeru priznanje izgubi dokazno vrednost. Priznanje lahko kasneje zelo skrajša kazenski postopek, še posebej po uvedbi novega Zakona o kazenskem postopku, kjer je predvidena milejša kazen za tistega, ki prizna, in s tem se seveda skrajša tudi postopek. Ko se priznanje pridobi, je potrebno preveriti, ali je priznanje resnično in verodostojno, saj velikokrat prihaja do lažnih priznanj in s tem nedolžno obsojenih. Na priznanje najbolj vplivajo objektivne okoliščine kaznivega dejanja, osebnostne značilnosti osumljenega ter osebnostne značilnosti in sposobnosti kriminalista. Za zaključek sem opisala slovenski primer Radenka Đurđevića, ki naj bi leta 2009 domnevno umoril partnerja svoje sestre, vendar je zaradi zmede na sodiščih in preslabih dokazov še zmeraj na prostosti, čeprav je njegov primer šel čez kompletno slovensko sodstvo.

Secondary abstract: Confession is a broad term, and it is not something that is easily obtained, as suspect tend to conceal their actions to avoid punishment. The police officer’s goal is to obtain a confession from the suspect in informative interviews, while the suspects goal is not to incriminate him or herself. Both subjects use different techniques and strategies to achieve their purposes, however the police officer must be careful to use legal methods only, because if he does not, the confession he obtains in this way cannot stand in court. A confession can substantially shorten criminal proceedings, especially after the introduction of the new Criminal Procedure Act (ZKP), which provides lower sentences for defendants who confess their crime; this of course shortens the entire procedure. When a confession is obtained, it is necessary to check its veracity, since false confessions are often given, and these can cause innocent people to be convicted. The confession is most affected by the objective circumstances of the crime, the personal characteristics of the suspect and the personal characteristics and skills of the police officer. A criminal case from the Slovene courts is studied in this paper, involving Radenko Đurđević, who in was indicted in 2009 for the murder of his sister’s partner, but is still a free man due to confusion in the courts and weak evidence, despite the fact that his case has been tried at all levels of the Slovenian justice system.
