Abstract

Magistrsko delo obravnava Globalni dogovor o beguncih in mednarodno pravno ureditev na področju zaščite beguncev, ki se je začela s sprejetjem Konvencije o statusu beguncev leta 1951. Poleg dogovora in konvencije delo obravnava začetke in delovanje Agencije ZN za begunce (UNHCR), opravljen je kratek pregled vzrokov za begunstvo in kakšna je situacija na področju begunstva danes. Opravljena je primerjava med Globalnim dogovorom o beguncih in Konvencijo o statusu beguncev ter pregled sprememb* na področju varstva beguncev na nivoju OZN in EU. Pri raziskovanju so bile uporabljene osnovne metode družboslovnega raziskovanja: zgodovinsko deskriptivna metoda, opis, primerjava, normativno-dogmatična metoda, analiza, sinteza, ocena in komentar. Cilj raziskave je bil opraviti analizo in primerjavo Konvencijo o statusu beguncev z Globalnim dogovorom o beguncih in preveriti, ali je Globalni dogovor o beguncih pravilna smer za nadaljnje spremembe in poenotenje zakonodaje na področju begunstva. Raziskovanje je podalo odgovor, da je Konvencija o statusu beguncev zagotovila beguncem pravice in državam gostiteljicam naložila nekatere dolžnosti, Globalni dogovor o beguncih pa poskuša zajeti, kako te pravice in dolžnosti izvajati v praksi. Dogovor kot tak ni pravno zavezujoč akt, ampak temelji predvsem na politični volji. Delo in rezultati lahko služijo kot osnova za strategijo zaščite beguncev.

Secondary abstract: This Master's thesis examines the Global Compact for Refugees and the international legal framework for refugee protection, which began with the adoption of the 1951 Convention relating to the Status of Refugees. In addition to the Agreement and the Convention, the work looks at the origins and functioning of the UN Refugee Agency (UNHCR), a brief overview of the causes of refugees and the situation of refugees today. A comparison is made between the Global Compact for Refugees and the Convention relating to the Status of Refugees, and an overview is given of changes in refugee protection at the UN and EU levels. The basic methods of social science research were applied: historical descriptive method, description, comparison, normative dogmatic method, analysis, synthesis, evaluation and commentary. The research aimed to analyse and compare the Refugee Convention with the Global Compact on Refugees and to see whether the Global Compact on Refugees is the right direction for further changes and unification of refugee law. The research responded that the Refugee Convention provided rights to refugees and imposed certain duties on host countries, while the Global Compact on Refugees seeks to capture how these rights and duties are implemented in practice. As such, the agreement is not a legally binding act but is based primarily on political will. The work and results can serve as a basis for a refugee protection strategy.
