Abstract

Izkoriščanje bolniškega staleža oz. njegova zloraba je ena najpogostejših kršitev iz delovnopravnega razmerja. Takšno dejanje je kršitev zadnje alineje 111. člena Zakona o delovnih razmerjih, ta pa ima za pravno posledico izredno odpoved pogodbe o zaposlitvi s strani delodajalca. Postopek pred samo odpovedjo pogodbe mora temeljiti na zakonskih podlagah, zato je pomembno, da se postopek pravilno izvede in da se delavcu omogoči zagovor. Izpolnjene morajo biti še marsikatere druge predpostavke, saj ima nepravilna izvedba postopka za posledico nezakonitost izredne odpovedi. Proces, ki se odvija pred samo odpovedjo pogodbe je pomemben ne samo za delavca ampak tudi za delodajalca, zato se ga moramo lotiti pravilno. Ključnega pomena za ugotovitev zlorabe bolniškega staleža pa so laične kontrole. Vsaka oseba, ki je v delovnem razmerju se dnevno sooča s situacijami, ki so povezane z delom in odnosom med njo in njenim delodajalcem. Zaradi varstva pravic delavca pred neutemeljenim odpuščanjem, je zakonodaja naravnana v prid šibkejši stranki - v našem primeru je to delavec, zaradi česar se delodajalec velikokrat znajde v neugodnem položaju, v katerem se počuti, kot da ima "zvezane roke".

Secondary abstract: Abuse of sick leave is one of the most common violations of employment relationships. Such abuse represents the violation of the final paragraph of Article 111 of the Employment Relationships Act, and its legal consequence is an extraordinary termination of an employment contract. Proceedings before the contract termination, must be based on legal basis. It is important, however, that procedure is carried out correctly, and that employees are able to defend themselves. Furthermore, many other pre-assumptions must be fulfilled, since an incorrect implementation of the procedure is subsequently followed by an unlawful extraordinary termination of an employment contract. This is a process that takes place just before the termination and it is important not only for workers but also for the employer, so it should be properly addressed. The key to determining the abuse of sick leave is also a random control. Any employed person daily faced with situations that are associated with the work and the relationship between her and her employer. In order to protect the rights of workers against unjustified dismissal legislation is oriented in favor of the weaker party – in our case that is a worker, which makes the employer often finds himself in an uncomfortable situation where he feels like it has a "tied hands".
