Abstract

Zakon o malem delu naj bi sistemsko uredil področje dela dijakov in študentov, upokojencev in brezposelnih oseb. Uredil bi področje trenutnega študentskega dela. Reševal bi problem izkoriščanja statusa v namen opravljanja študentskega dela. Osebam, ki bi opravljale malo delo, bi zagotovil zdravstveno zavarovanje in priznane delovne izkušnje, kar do sedaj pri študentskem delu ni bilo upoštevano. Zakon bi omogočal bolj urejena delovna mesta, zagotovil bi izplačila za opravljena dela ter del denarja, zasluženega z malim delom, namenil štipendijam in obštudijskim dejavnostim. Z zakonom bi tudi pridobili več štipendij ter rednih zaposlitev, saj bi bili delodajalci omejeni z zaposlovanjem malih delavcev. Kljub prizadevanjem predlagateljev Zakon o malem delu ni bil uveljavljen. Po sprejetju zakona so ga volivci na referendumu zavrnili. V zvezi s sprejemom in uveljavitvijo oziroma njegovo zavrnitvijo na referendumu je namen diplomskega dela poiskati razloge za zavrnitev zakona, preučiti seznanjenost dijakov in študentov z zakonom ter raziskati prednosti in slabosti malega dela. Zaradi lažjega razumevanja je v diplomski nalogi delno analizirana vsebina Zakona o malem delu. Zakon vključuje tudi brezposelne osebe in upokojence. V diplomski nalogi smo se osredotočili samo na študente.

Secondary abstract: The law on small work was designed to regulate the field of work of students, pensioners and of the unemployed systematically. It was supposed to settle the current position of student work. It was also meant to solve the problem of misuse of the student status so that one can work as a student. It would have provided those performing the student work health insurance and recognize work experience, which until now has not been the case with student work. The act would have allowed more regulated positions of employment, it would have guaranteed payment for the work carried out and part of it would have been contributed to scholarships and activities of students besides studies. By having enforced the law the number of scholarships and temporary employment would have increased as employers would have been restricted by employing those performing small work. Despite the efforts of those who had proposed it, the law was not passed. After the proposal of the law voters refused it in referendum. Regarding the passing and enforcing the law or refusing the law in referendum respectively, the aim of the diploma dissertation was to find reasons for the law to be refused, to find the answers on to what extent secondary schools students and university students are acquainted with the law, as well as to look at the advantages and the disadvantages of small work. The law also includes the unemployed and pensioners. In the diploma dissertation we focus only on university students.
