Abstract

Temeljna pravica, ključna za oblikovanje posameznikove identitete, je nedvomno pravica do poznavanja lastnega izvora. Ustavno sodišče Republike Slovenije ji je priznalo celo naravo temeljne človekove pravice. Kot pomembna pravica, pa je priznana tudi v sklopu številnih mednarodnih pravnih aktih. Življenjske situacije, ki vodijo do želje po poznavanju lastnega izvora ter razkritja identifikacijskih podatkov bioloških staršev, so spočetje otroka s postopkom oploditve z biomedicinsko pomočjo z darovano spolno celico, posvojitve, ter razne druge situacije, v katerih otrok ne pozna svojih bioloških staršev. Da otrok lahko uveljavlja svojo pravico do poznavanja lastnega izvora, mora v prvi vrsti biti izpolnjen pogoj, da otrok ve za obstoj svojih bioloških staršev. Nadaljnji pogoj predstavlja obstoj dokumentacije, v sklopu katere se vodijo informacije o izvoru otroka. Zadnji pogoj pa predstavlja še upravičenje otroka, da dostopa do informacij, ki jih zajema sama dokumentacija. Našteti pogoji veljajo predvsem v postopkih spočetja otroka s postopkom oploditve z biomedicinsko pomočjo z darovano spolno celico ter pri posvojitvah. V ostalih življenjskih primerih, kjer podlaga za poznavanje lastnega izvora temeljni zgolj na otrokovi želji, je treba zagotoviti sodno varstvo.

Secondary abstract: A fundamental right, crucial to the formation of an individual's identity, is undoubtedly the right to know one's origins. The Constitutional Court of the Republic of Slovenia has even recognised it as a fundamental human right. As an important right, it is also recognised in a number of international legal instruments. Life situations that lead to the desire to know one's own origin and to disclose the identifying data of the biological parents are the conception of a child by means of a procedure of assisted reproduction with donated sex cells, adoption, and various other situations in which the child does not know his or her biological parents. In order for a child to be able to exercise his or her right to know his or her own parentage, the condition that the child knows of the existence of his or her biological parents must first be met. A further condition is the existence of documentation in the context of which information on the origin of the child is kept. The last condition is the child's right to have access to the information contained in the documentation itself. The above conditions apply in particular to conception of a child by means of a procedure of assisted reproduction with donated sex cells and to adoption. In other life situations, where the basis for knowledge of one's own origin is based solely on the child's wishes, judicial protection must be ensured.
