Abstract

Diplomsko delo, ki je pred vami, analizira nedavno sprejeto sodbo Splošnega sodišča Evropske unije v zadevi Republika Slovenija proti Evropski komisiji (T-626/17), ki obravnava vprašanje porekla terana. Zanimalo nas je, kakšno je zgodovinsko ozadje študije primera teran, kako poteka postopek za razglasitev ničnosti sekundarne zakonodaje s strani Splošnega sodišča; in kakšno vlogo igra geografska označba v obravnavani sodbi. Uvodoma smo preučili postopek ničnostne tožbe po pravu Evropske unije ter s pomočjo zgodovinske metode povzeli izbrano dosedanjo sodno prakso Splošnega sodišča v teh postopkih. Po predstavitvi dejanskega stanja smo obravnavano sodbo z uporabo metode analize tudi preučili. V sklepnem delu diplomskega dela smo pojasnili, kateri razlogi so vodili k začetku postopka Slovenije proti Evropski komisiji pred Splošnim sodiščem ter vlogo, ki jo je pri tem imela geografska označba. Tekom pisanja smo si zastavili tri raziskovalna vprašanja, na katera smo tekom pisanja poiskali odgovore. Za konec smo strnili tudi odzive na sodbo obeh udeleženih straneh. Pomembno je zavedanje, da teran predstavlja simbol slovenske identitete. Ker podobnih ikon nimamo v izobilju, je pomembno, da smo na njih ponosni in se za njih borimo.

Secondary abstract: This thesis analyzes the recently adopted judgment of the General Court of the European Union against the Republic of Slovenia against the European Commission (T-626/17), which deals with the issue of the origin of Teran. We were interested in the historical background of the Teran case study, how goes the procedure for action of annulment and what is the role of geographical indication in this verdict. Firstly, we examined the action for annulment under European Union law and later on, we use historical method to summarized the selected cases as judicial practice of the General Court. After presenting the facts, we also discussed the judgment using the methods of analysis. In the concluding part of the diploma work, we explained the reasons that led to the beginning of that trial of Slovenia against the European Commission. During the writing we propose three research questions, to which we found answers during the writing. Finally, we also summarized the responses to the judgment of both parties involved. It is important to be aware that the Teran is a symbol of Slovenian identity. Because we do not have a lot of similar icons, it is important that we are proud of them and fight for them.
