učinek migracijske krize leta 2015 na implementacijo Uredbe Dublin III
Abstract
Delovanje Evropske unije v času migracijskih kriz je bilo pogosto deležno številnih kritik, predvsem kadar je to imelo širše varnostne in socialne učinke ter ko so se pokazala močno nasprotujoča mnenja držav članic Evropske unije in njihovih voditeljev. Ideja popolne implementacije evropske zakonodaje na področju skupne azilne politike v vseh državah članicah se je tudi v času migracijske krize leta 2015 pokazala za neizvedljivo, saj je omogočala individualno interpretacijo pomembnih delov azilne zakonodaje. S tem so se pojavile velike razlike v sprejemanju prosilcev za azil ter obravnavanju njihovih prošenj med ciljnimi državami in tistim državami, ki so se temu uspele izogniti. Cilj naloge je pojasniti, zakaj so izbrane države članice delovale na različne načine pri sprejemanju prosilcev za azil, in kaj je k temu delovanju pripomoglo. Analiza Uredbe Dublin III, ki je bila v veljavi v času migracijske krize leta 2015, in njena implementacija, pokažeta, da uredba ni bila enako implementirana v vseh državah članicah. Na primeru štirih izbranih držav – Nemčija, Švedska, Francija in Madžarska, analiza pokaže, da države članice Evropske Unije uredbo Dublin III v nacionalni pravni red ne implementirajo enotno in ne upoštevajo hierarhije kriterijev, ki določajo državo, odgovorno za obravnavo prošnje. Prav tako nam analiza pokaže, da je bilo delovanje DČ EU v času migracijske krize 2015 odvisno od števila prosilcev za azil, geografske lege in skladnosti evropske zakonodaje z nacionalnim pravnim redom.

The actions of the European Union during migration crises have always been questioned, especially when it affected broader security and social aspects, and when strongly opposing opinions of the European Union member states and their leaders were exposed. The idea of full implementation of European legislation in all member states also proved to be unfeasible during the 2015 migration crisis, because it allowed for individual interpretation of the asylum legislation. This led to large differences in the acceptance of asylum seekers and the handling of their applications between the target countries and those that managed to avoid it. The aim of the thesis is to explain, why the selected Member States have acted in different ways in receiving asylum seekers and what has contributed to this performance. In the case of the four selected countries - Germany, Sweden, France and Hungary, the analysis shows that EU Member States do not implement Dublin III uniformly in their national legal order and do not follow the hierarchy of criteria determining the country responsible for examining an application. The analysis also shows that the performance of EU MS during the 2015 migration crisis depended on the number of asylum seekers, their geographical location and the consistency of European legislation with national law. |
