Abstract
V diplomskem delu smo opredelili pomen policijskega postopka pri obravnavi kršitev s področja udeležbe v cestnem prometu pod vplivom psihoaktivnih snovi. Diplomsko delo je razdeljeno na teoretični in empirični del. Za dosego cilja diplomskega dela smo postavili tri hipoteze. V teoretičnem delu diplomskega dela smo na splošno predstavili področje psihofizičnega stanja udeležencev cestnega prometa, alkohol in psihoaktivne snovi ter vpliv za voznika, ki je pod vplivom teh substanc. Predstavili smo splošna policijska pooblastila in konkretneje pooblastila ob nadzoru cestnega prometa. Opredelili smo osnovne pojme, kot je policijsko pooblastilo v smislu zakonske podlage, zakonsko podlago za izvajanje kontrole cestnega prometa in vodenje prekrškovnega postopka v primeru zaznanih kršitev. Ugotovili smo bistveno razliko med odkrivanjem kršitev s področja vožnje pod vplivom alkohola in kršitev s področja vožnje pod vplivom psihoaktivnih snovi. Policisti alkoteste običajno odrejajo rutinsko, pri odreditvi strokovnega pregleda zaradi ugotavljanja prisotnosti psihoaktivnih snovi pa mora policist predhodno potrditi sum, da je voznik pod vplivom teh snovi. Podrobno smo predstavili zakonsko podlago in prekrškovni postopek z voznikom pod vplivom psihoaktivnih snovi, kakor tudi dodatno ukrepanje policista poleg obravnave samo osnovnega prekrška. V empiričnem delu smo opravili analizo javno dostopne statistike policije za obdobje zadnjih 10 let. Za ta namen smo uporabili statistične podatke ukrepov policije s področja psihofizičnega stanja udeležencev cestnega prometa. Pri analizi smo ugotovili anomalijo uradne policijske statistike. Število odrejenih strokovnih pregledov zaradi ugotavljanja psihoaktivnih snovi namreč z leti narašča, v zadnjem letu jih je bilo odrejenih približno dvakrat toliko kot 2012, število pozitivnih rezultatov strokovnega pregleda pa ne glede na večje število odrejenih pregledov celo upada. Za namen raziskave smo zato pri analizi statističnih podatkov uvedli vsoto pozitivnih rezultatov strokovnega pregleda in odklonov, s čimer smo potrdili, da je število voznikov pod vplivom psihoaktivnih snovi v vzponu praktično skoraj vsako leto v obravnavanem obdobju. V zaključku diplomskega dela smo testirali predpostavljene hipoteze in obrazložili ugotovitve.

Police procedure with road participants under influence of psychoactive substances |

In the thesis we defined the importance of the police procedure in dealing with violations in the field of participation in road traffic under the influence of psychoactive substances. The thesis is divided into a theoretical and an empirical part. In order to achieve the goal of the thesis, we set three hypotheses. In the theoretical part of the thesis, we generally presented the field of psychophysical condition of road traffic participants, alcohol and psychoactive substances and the impact on the driver who is under the influence of these substances. We presented general police powers and more specific powers for road traffic control. We have defined basic concepts such as police authorization in terms of legal basis, legal basis for the implementation of road traffic control and management of misdemeanor proceedings in case of detected violations. We found a significant difference between the detection of violations in the field of driving under the influence of alcohol and violations in the field of driving under the influence of psychoactive substances. In detail we have presented the legal basis and the misdemeanor procedure with a driver under the influence of psychoactive substances, as well as the additional actions of the police officer, in addition to dealing with only the basic violation. In the empirical part, we performed an analysis of publicly available police statistics for the period of the last 10 years. For this purpose we used statistical data of police measures in the field of psychophysical condition of road traffic participants. During the analysis, we found an anomaly in the official police statistics. The number of expert examinations ordered for the detection of psychoactive substances has been increasing over the years, in the last year there were ordered approximately twice as many as in 2012, regardless, the number of positive results of the expert examination, in relation to the greater number ordered, is falling. For the purpose of the research, in the analysis of statistical data, we introduced the sum of the positive results of the professional examination and declines, which confirmed that the number of drivers under the influence of psychoactive substances is on the rise almost every year during the research period. At the end of the thesis, we tested the assumed hypotheses and explained the findings. |
