Abstract
Magistrsko delo skuša vsebinsko analizirati vse utemeljene pritožbe zoper delo policistov in njihov potek razrešitve od leta 2015 do leta 2020. Za pridobitev podatkov smo zaprosili Ministrstvo za notranje zadeve, Direktorat za policijo in druge varnostne zadeve, Sektor za pritožbe zoper policijo. Raziskava je obsegala 74 utemeljenih pritožb iz celotnega območja Republike Slovenije. Ugotovili smo, da je pritožbe sestavljalo 108 pritožbenih razlogov. Ugotovili smo, da največ pritožbenih razlogov ni bilo iz komunikacije, ki se kaže v nedostojnem in nekorektnem odnosu, kot smo pričakovali, temveč iz opustitve dejanja ali neukrepanja policistov. Več razlogov kot iz nedostojne komunikacije je bilo tudi iz kategorije prekoračitev oziroma neupravičena ali nesorazmerna uporaba različnih policijskih pooblastil. Nedostojna komunikacija je prednjačila samo pred kategorijo neupravičene ali nesorazmerne uporabe prisilnih sredstev. Tudi nobena od nadaljnjih ugotovitev ni bila skladna s pričakovanji, saj smo pričakovali, da bo večina utemeljenih pritožb (izhajajoč iz postopka v »Zakonu o nalogah in pooblastilih policije (ZNPPol)«, (2013)) obravnavana prvo na pomiritvenih postopkih in nato pred pritožbenim senatom. Pričakovali smo tudi (izhajajoč iz Kaluža, 2018), da bo geografsko največ utemeljenih pritožb na območjih policijskih uprav Ljubljana in Novo mesto. Ugotovljeno je bilo, da se večina pritožb obravnava neposredno na senatu, in da je geografsko največ pritožb na območjih policijskih uprav Ljubljana in Maribor. Ugotovitve o vsebini pritožbenih razlogov kažejo podobnosti z ugotovitvami iz Kaluža (2018), kjer so pričakovanja, povezana z nedostojno komunikacijo, bila enako zavrnjena.

Analysis of valid complaints against the work of police officers between 2015 and 2020 |

In this master's thesis we tried to analyse all valid complaints from 2015 to 2020 against the work of police officers and the paths how the complaints were resolved. For the information we needed we asked the Ministry of the Interior, Police and Security Directorate, Police Complaints Division for documentation regarding complaints that were submitted against police officers. The research analysed 74 valid complaints submitted against the work of police officers across the whole state of Slovenia. We found out, that the most numerous reasons for complaint submitted in complaints against police officers were failures of officers to act and not communication which shows inappropriate behaviour by the police officer. Not only was communication which shows inappropriate behaviour by the police officer not the most numerous reason, it was even lagging behind improper use of police authority. Communication was only ahead of restraint and coercive means. All other expectations we had were also different from results. We expected (concluding from the procedure prescribed in »Zakon o nalogah in pooblastilih policije (ZNPPol)«, (2013) [Police Tasks And Powers Act]) most valid complaints would be resolved in conciliation procedures and only if they failed would the complaint be handled at the Complaint panel. Our results showed, that most complaints were directly handled and resolved at the complaint panel and not at the conciliation procedure. We also expected (on the basis of a similar research conducted by Kaluža, 2018) that most valid complaints would be filled at the police directorates of Ljubljana and Novo mesto. The results showed that most complaints were actually filled at the police directorates of Ljubljana and Maribor. Results pertaining the substance of complaints have found similarities with conclusions reached in a similar work conducted by Kaluža (2018) where expectations connected to improper communication were similarly rejected. |
