Abstract

Povzetek Otroci kot žrtve, priče ali storilci kaznivih dejanj igrajo aktivno vlogo v dejavnostih, povezanih z raziskavo v okviru forenzičnih zaslišanj. Postopek intervjuvanja otrok, ki pričajo o zlorabah, ima strukturo, vendar je tudi tekoč proces. Ena najpomembnejših stvari pri intervjuvanju otrok, ki so bili žrtve, priče ali storilci kaznivega dejanja, je pridobivanje podrobne in točne informacije na pravno obramben način, brez hkratnega ogrožanja otrok. Uspeh intervjuja je odvisen od sposobnosti, potenciala, spretnosti in količine znanja izpraševalcev. S staranjem nenehno razvijamo svoje kognitivne, socialne in čustvene sposobnosti ter povečujemo svojo sposobnost, da se vključimo v hipotetično in logično odločanje, da si zapomnimo in zanesljivo poročamo o dogodkih ali kakršnih koli informacijah. V diplomski nalogi se raziskuje pot občutljivega in natančnega procesa, imenovanega »forenzični intervju«, s posebnim poudarkom na sklop vprašanj, ki imajo pomembno vlogo pri odkrivanju kaznivih dejanj. Diplomsko delo obravnava izključno mladoletne osebe (otroci do 12 let in mladostniki), katerih položaj je bistveno drugačen od položaja odraslih. Ugotavljamo, da se pričevanja otrok, ki so bili storilci, priče ali žrtve kaznivega dejanja, razlikujejo od pričevanja odraslih. Pri tem raven otrokovega spomina in komunikacijskih sposobnosti močno vpliva na kakovost in uspešnost razgovora. Zato je pri zaslišanju mladoletnikov še toliko bolj pomemben sočuten, strpen in neavtoritativen način zaslišanja, ki ga izvedejo strokovno usposobljeni preiskovalci.

Secondary abstract: Abstract Children as victims, witnesses or perpetrators of abuse play an active role in research- related activities in the context of forensic interrogations. The process of interviewing children who witness abuse has a structure, but it is also an ongoing process. One of the most important things from children who have been victims, witnesses or perpetrators of abuse is to obtain detailed and accurate information in a legally defensive way, meanwhile, without endangering children, success depends on the ability, potential, skills and knowledge of interviewers. With age, we are constantly developing our cognitive, social, and emotional abilities. As we age, we increase our ability to engage in hypothetical and logical decision-making, to remember and reliably report events or any information. The thesis explores the path of a sensitive and precise process called “forensic interviews”, with special emphasis on a specific set of questions that play an important role in detecting crime. The thesis deal exclusively with minors (children up to 12 years of age and adolescents), who situation in significantly different from that of adults. We conclude that the testimonies of children who were perpetrators, witnesses or victims of abuse differ from the testimonies of adults. Here, the level of the child's memory and communication skills greatly affects the quality and success of the interview. Therefore, when interogating minors, a compassionate, tolerant and non- authoritative approach of questioning by professionally qualified investigators is very important.
