Pragmatični zakon

Abstract

The article "Pragmatic law" analyses the social spheres, which directly affect the civil and existential status of gays and lesbians: the law and mediaimages of homosexuality. In the first part - in chapters "Law and representations" and "Pragmatic law" - the author explains why the demands of gays and lesbians are directed toward the legal system and why the question of homosexuality is in fact the topic, concerning the discourse of human or civil rights and why only such a context leads to the resolving of second-class citizenship of the exual-sex pupulation. In the second part of the article, in the chapters "Media and representation" the authors describes the popular ways of representing homosexuality, gays and lesbians in the media of the nineties; she detects the so-called "lesbian chic" phenomenon also in Slovenian media space and questions the possible consequences of popular media policy for the position of homosexuality in the public sphere.

Secondary abstract:	Tekst "Pragmatični zakon" se, ob poskusih detektiranja civilnega in eksistenčnega statusa homoseksualcev in lezbijk, spušča v družbeni sferi, ki neposredno zadevata njihov socialni položaj: v pravni red ter v medijske podobe o homoseksualnosti . V prvem delu, ki ga sestavljata poglavji "Pravo in reprezentacija" in "Pragmatično pravo", avtorica podrobneje ugotavlja, zakaj se zahteve gejev in lezbijk usmerjajo k pravnemu sistemu in zakaj je vprašanje homoseksualnosti pravzaprav tema, ki se tiče diskurza o človekovih ali državljanskih pravicah ter svoboščinah oziroma zakaj lahko le takšen kontekst govora o homoseksualnosti vodi k reševanju statusa drugorazrednega državljanstva istospolne populacije. V drugem delu, v poglavju "Mediji in reprezentacija", se avtorica, z navezovanjem na soodvisnost moči množičnih medijev in demokratične kulture, dotika popularnih načinov predstavljanja homosekusalnosti, gejev ali lezbijk v medijih devetdesetih let, odkriva razširjenost tako imenovanega 'lezbičnega šika' tudi v slovenskem medijskem prostoru oziroma ugotavlja možne posledice populoidnega medijskega pristopa za samo pozicijo homosekusalnosti v javnem prostoru.
