Abstract
Za pričetek izvajanja pooblastil in nalog policija načeloma potrebuje sprožilno situacijo, oziroma izpolnitev določenih pogojev s strani posameznika, ki dovoljujejo pričetek izvajanja pooblastil in nalog ter s tem poseg v človekove pravice in temeljne svoboščine. Z namenom, da se zoper osebo v postopku ne bi zlorabila ali prekoračila pooblastila s strani organov, ki vodijo postopek, pa je zakonodajalec sestavil varnostni mehanizem. Ta varnostni mehanizem sestavljajo varnostni in dokazni standardi, ki stremijo k temu, da se za dosego cilja uporabi najmilejše pooblastilo, saj se s tem na najmilejši možen način posega v posameznikovo življenje in zasebnost. Namen diplomske naloge je bralcem predstaviti sprožilno situacijo oziroma zakonsko določene pogoje za začetek policijskega postopka. Pri diplomskem delu smo si v zvezi z nalogo zastavili tri hipoteze, ki se nanašajo na policijske posege v človekove pravice in temeljne svoboščine. Opisali smo dokazne standarde in razloge za sum storitve kaznivega dejanja, varnostne standarde in verjetnosti pričakovanja, ter z izvlečki Zakona o kazenskem postopku, Zakona o nadzoru državne meje in Zakona o nalogah in pooblastilih policije pregledali dokazne in varnostne standarde v razmerju s posameznimi pooblastili policije s poudarkom-ločnico med »policist sme« in »policist lahko«. Analizirali smo primer odločbe Ustavnega sodišča glede rutinske kontrole prometa, tehtali policijska pooblastila v razmerju do varovanja človekovih pravic na protestnih shodih leta 2020 in primerjali tudi sprožilne situacije pri delu univerzitetne policije v Arkansasu v Združenih državah Amerike.

In order to start the exercise of powers and tasks, the police in principle need a triggering situation, or the fulfillment of certain conditions by the individual, which allow the start of the exercise of police powers and tasks and thus encroachment on human rights and fundamental freedoms of the individual. In order not to abuse or exceed the powers of the authorities in charge of the criminal procedure, the legislator created a security mechanism. This security mechanism consists of security and proof standards that aim to the use of the minimal possible intervention in the individual's life and privacy to achieve the goal. The purpose of the diploma thesis is to present to the readers the triggering situation or the legally defined conditions for the initiation of police proceedings. In the thesis, we set three hypotheses related to the police interventions in human rights and fundamental freedoms. We describe the principles of the evidentiary process and grounds for suspicion of a crime, the security standards and expected probabilities. Based on the Criminal Procedure Act, the State Border Control Act and the Police Tasks and Powers Act we examined the security and proof standards in relation to the powers of the police with the emphasis on the distinction between "the policeman may" and "the policeman can". We analyzed the Constitutional Court case regarding routine traffic control, weighed police powers in relation to the protection of human rights at protest rallies in 2020 and compared the triggering situations in the work of the university police in Arkansas in the United States of America. |
