Abstract
Zaključno delo obravnava preiskovanje osumljencev kaznivih dejanj, za katere je bilo odrejeno pridržanje na podlagi določil Zakona o kazenskem postopku. Pooblastilo, ki najbolj invazivno posega v človekove pravice in temeljne svoboščine, je ravno pridržanje oziroma odvzem prostosti. V teoretičnem delu diplomskega dela smo tako obravnavali pooblastilo za pridržanje na podlagi Zakona o kazenskem postopku in probleme, ki jih srečujejo policisti in policisti kriminalisti, ki so zaposleni na lokalni ravni – na policijskih postajah. Pri preiskovanju kaznivih dejanj, ki se preganjajo po uradni dolžnosti, in storilcih oziroma osumljencih, ki so prijeti na kraju kaznivega dejanja, je ključno, da policisti in policisti kriminalisti prepoznajo vse razloge, ki so potrebni za odreditev pridržanja na podlagi Zakona o kazenskem postopku. Za to je potrebno poznavanje zakonodaje in postopkov, ki jih določajo vsi zakoni in ne samo Zakon o kazenskem postopku in Kazenski zakonik. Prav tako je pomemben člen v uspešni preiskavi kaznivega dejanja in osumljenca v predkazenskem postopku sodelovanje med policisti in policisti kriminalisti, ki so zaposleni na lokalni ravni, in okrožnimi državnimi tožilci. Problemov v praksi pri tovrstnih opravilih je veliko, vendar smo se v zaključnem delu osredotočili na dva, ki sta po našem mnenju najpogostejša in najbolj vplivata na samo odreditev pridržanja in uspešen zaključek, to je podaja kazenske ovadbe zoper pridržanega osumljenca s podajo utemeljenih razlogov za odreditev sodnega pripora, ki jim kasneje sledi preiskovani sodnik. Prvi problem je nepoznavanje zakonodaje in pooblastil, ki jih imajo policisti in policisti kriminalisti, ki so zaposleni na lokalni ravni, drugi problem pa slabše sodelovanje z okrožnimi državnimi tožilci med izvajanjem opravil med pridržanjem in preiskovanjem kaznivih dejanj. V prvem delu zaključnega dela smo predstavili uradno statistiko pridržanih oseb na Policijski upravi Kranj, ki je pokazala, da se večina pridržanj, ki so odrejena na podlagi Zakona o kazenskem postopku, izvaja oziroma odredi ravno na policijskih postajah, torej na lokalni ravni. Analiza intervjuja okrožnih državnih tožilcev in skupinskega usmerjenega intervjuja policistov je pokazala, da je poznavanje zakonodaje ter postopkov sicer zadovoljivo, vendar so še možnosti za izboljšanje poznavanja zakonodaje in olajšanje postopkov. Prav tako je analiza pokazala, da je sodelovanje med okrožnimi državnimi tožilci in policisti, ki so zaposleni na lokalni ravni, razen v redkih primerih, korektno, pravočasno in kakovostno.

This thesis deals with the investigation of criminal suspects ordered to be detained under the provisions of the Criminal Procedure Act. It revolves around the fact that the most invasive interference with human rights and fundamental freedoms is the power of detention or deprivation of liberty. In the theoretical part of the thesis, we discuss the power of detention under the Criminal Procedure Act and the problems encountered by police officers and criminal investigators working at the local level – at police stations. When investigating ex officio offences and offenders or suspects who are arrested at the scene of a crime, it is crucial that police officers and criminal investigators identify all the grounds necessary to order detention under the Criminal Procedure Act. This requires knowledge of the law and procedures laid down by all laws, not just the Criminal Procedure Act and the Criminal Code. Another important factor in the successful investigation of a criminal offence and of a suspect in pre-trial proceedings is the cooperation between police officers and criminal investigators employed at the local level and district state prosecutors. There are many problems in practice with this type of work, but in the final part of this thesis we focus on two of them, which in our opinion are the most common and have the greatest impact on the actual ordering of detention and its successful conclusion, i.e. the filing of a criminal complaint against the detained suspect, with the provision of reasonable grounds for the ordering of judicial custody, which are subsequently followed up by the investigating magistrate. The first problem is the lack of knowledge of the law and the powers that police officers and criminal investigators working at the local level have, and the second problem is poor cooperation with district state prosecutors when carrying out tasks during detention and investigation of crimes. In the first part of the thesis, we present the official statistics of detained persons at the Kranj Police Directorate, which showed that the majority of detentions ordered on the basis of the Criminal Procedure Act are carried out or ordered at police stations, i.e. at the local level. The analysis of the interview of district state prosecutors and the focus group interview of police officers showed that, while knowledge of the law and procedures is satisfactory, there is still room for improvement both in terms of knowledge and the facilitation of procedures. The analysis also showed that, with few exceptions, the cooperation between district state prosecutors and police officers working at the local level is appropriate, timely and of good quality. |
