Abstract
Javno naročanje se nanaša na postopek, ki ga uporablja javni sektor pri pridobivanju blaga, storitev ali gradenj od zasebnega sektorja. Gre za formalni proces, v katerem javni organi objavljajo javna naročila, ki opredeljujejo njihove potrebe, zahteve in pogoje, ter vabijo potencialne ponudnike, da predložijo ponudbe za izpolnitev teh zahtev. Varstvo konkurence v postopkih javnega naročanja je ključnega pomena za učinkovito porabo javnih sredstev, spodbujanje konkurence med ponudniki in zagotavljanje kakovostnih izdelkov in storitev za javni sektor. Pravilna izvedba postopkov in dosledna uporaba konkurenčnih načel prispevata k transparentnosti, poštenosti in učinkovitosti javnega naročanja. DKOM ima v revizijskem postopku pristojnost, da zavrne zahtevek za revizijo kot neutemeljen ali pa mu ugodi in razveljavi postopek oddaje javnega naročila bodisi delno bodisi v celoti. V primeru razveljavitve je DKOM dolžna naročniku podati napotke za pravilno izvedbo postopka oddaje javnega naročila v delu, ki je bil razveljavljen.
V delu diplomskega projekta je predstavljeno varstvo konkurence v postopkih javnega naročanja. Na podlagi statističnih podatkov so se deleži javnih naročil v bruto domačem proizvodu od leta 2018 povečevali. Iz odločb DKOM je razvidno, da naročniki v veliki meri spoštujejo ZJN-3. Predstavljen je tudi konkurenčni dialog in vzpodbujanje le-tega. V nadaljevanju je osredotočenost na praktične primere iz odločitev DKOM, izbrani so trije primeri, na podlagi katerih je DKOM odločala, ali naročniki spoštujejo temeljna načela javnega naročanja, predvsem pa načelo zagotavljanja konkurence (5. člen ZJN-3).

Public procurement refers to the process used by the public sector to acquire goods, services, or constructions from the private sector. It is a formal process in which public authorities publish public contracts that define their needs, requirements, and conditions, and invite potential tenderers to submit offers to meet these requirements. Ensuring competition in public procurement procedures is crucial for the efficient use of public resources, promoting competition among tenderers, and ensuring the provision of quality products and services to the public sector. Proper implementation of procedures and consistent application of principles contribute to the transparency, fairness, and efficiency of public procurement. National Review Commission has the authority to reject a request for revision as unfounded or to grant it and annul the public procurement process, either partially or entirely. In the case of annulment, National Review Commission is obligated to provide the public authority with instructions for correctly conducting the public procurement procedure in the part that was annulled.
The protection of competition in public procurement procedures is presented in this part of the diploma project. Based on statistical data, the shares of public procurement in gross domestic product (GDP) have been increasing since 2018. Decisions of the National Review Commission show that contracting authorities largely do not violate the Public Procurement Act. Competitive dialogue and its promotion are also presented. Furthermore, the focus is on practical examples from National Review Commission decisions and three cases are selected based on which National Review Commission decided whether contracting authorities adhere to the principles of public procurement, especially the principle of competition among tenderers (Article 5 of Public Procurement Act). |
