Abstract

Za svetovno nizko stopnjo števila zaprtih žensk gre razloge iskati v večji konformnosti žensk do kazenskopravnih norm in posledično nižjo udeležbo v deviantnih in kriminalnih dejanjih. Gre za fenomen tako formalnega kot neformalnega družbenega nadzorstva nad ženskami, sestavljenega iz številnih neformalnih pravil in pričakovanj, izhajajočih iz spolnih ideologij in struktur, ki zmanjšujejo možnosti za kršenje pravil in izvajanje kaznivih dejanj. V zaključnem delu se osredotočamo na dinamiko odnosov in zaznano stopnjo legitimnosti zaporskih delavcev pri obsojenkah v Zavodu za prestajanje kazni zapora Ig. V študiji je bila preučena domača in tuja literatura in do sedaj opravljene študije o odnosih in legitimnosti zaporskih sistemov, poleg teoretičnega pregleda je bila opravljena tudi kvalitativna študija v edinem ženskem zaporu v Sloveniji, na Igu. S pomočjo strukturiranih intervjujev z obsojenkami so bile merjene različne spremenljivke o odnosih med zaporskimi akterji, zaznavi legitimnosti zaporskih delavcev pri obsojenkah in njihovi prilagoditvi ter zadovoljstvu z zaporskim sistemom. Ugotovitve so pokazale, da odnosi med zaporskimi akterji predstavljajo srce dobro delujoče zaporske institucije, ki temelji na spoštovanju, zakonitosti in pravičnosti. Dinamičnost in dualnost odnosov med zaporskimi delavci in obsojenkami pa hkrati predstavljata strukturni konflikt, ki ga žene neenakovreden položaj zaporskih akterjev, tj. nosilcev moči in njegovih prejemnikov. Kakovostni odnosi vodijo do razvoja zaupanja pri obsojenkah v avtoriteto zaporskih delavcev, kar predstavlja temelj legitimnega in učinkovitega zaporskega sistema. Razumevanje kompleksnosti in dinamičnosti zaporskega okolja se je izkazalo za ključno pri implementaciji dobrih praks, usmerjenih v resocializacijo obsojenk.

Secondary abstract: The reason for the lower rate of incarcerated women worldwide can be found in the greater conformity of women to the norms of criminal law, which results in a lower involvement in deviant and criminal acts. It is a phenomenon of both formal and informal social control over women, comprised of several informal rules and expectations that derive from gender ideologies and structures, all of which lower the possibilities of women breaking rules and engaging in criminal acts. The thesis focuses on the dynamics of the relationships and the perceived level of legitimacy of prison workers among the female prisoners in Ig prison. The study examines domestic and foreign literature as well as previous studies on the relationships and the legitimacy of prison systems. In addition to the theoretical overview, a qualitative study was performed at Ig prison (the only prison for women in Slovenia). Through structured interviews with female inmates, several variables were measured: relations between prison workers and prisoners, prisoners' perception of prison workers' legitimacy, and their adaptation to and satisfaction with the prison system. Findings show that the relations between prisoners and prison workers, based on respect, legality and fairness, are at the core of a well-functioning prison institution. However, the dynamics and the duality of the relationship between these two groups also represent a structural conflict, fueled by the non-equal positions of both groups. Quality relations influence prisoners' trust in prison workers and their authority, which is the basis of a legitimate and effective prison system. Understanding the complexity and dynamics of a prison environment proves to be crucial for implementing good practices aimed at the re-socialization of female prisoners.
