Abstract

Zadnjih nekaj let se je svet soočal s pomembnimi prelomnicami, ki segajo od ekonomske krize do pandemije covid-19. V tem času so bili na preizkušnji vsi vidiki človekovega obstoja. Takšni dogodki vplivajo na državo blagostanja, brezposelnost in revščino, zdravstvo ter izobraževanje. Kar pa ima pomemben vpliv na otrokove pravice, njihovo uresničevanje in varstvo. Kljub vseobsegajoči zmedi so posamezniki in državni organi, pri uresničevanju ter varstvu otrokovih socialnih in ekonomskih pravic, kot temeljno vodilo dolžni upoštevati otrokovo korist. Socialne in ekonomske pravice otrok so varovane na mednarodni, regionalni in nacionalni ravni. Na mednarodni ravni je pomembna predvsem Konvencija o otrokovih pravicah, katera je povzročila prenos težišča od varstva otroka na varstvo njegovih pravic. Socialne in ekonomske pravice otrok so označene kot pravice pozitivnega statusa, kar pomeni, da je za njihovo uveljavljanje potrebna določena stopnja aktivnosti države, enako velja za njihovo varstvo. Ne glede na njihovo naravo, pa so za njihovo uresničevanje v prvi vrsti odgovorni starši. Slednji morajo vedno gledati na otrokove najboljše interese in njegovo dobrobit. Le v primeru, da to s strani primarnih nosilcev zagotavljanja otrokovih pravic ni zadovoljivo doseženo, stopijo v ospredje različni ukrepi, s katerimi se posega v starševsko skrb in ki predstavljajo intervencijo države. Kljub širokemu spektru ureditve, lahko še vedno zaznamo kakšno odprto vprašanje oziroma področje, ki bi ga bilo potrebno raziskati in urediti.

Secondary abstract: Over the last few years, the world has faced major turning points, ranging from the economic crisis to the covid-19 pandemic. During this time, all aspects of human existence have been challenged. Such events affect the welfare state, unemployment and poverty, health and education. Which in turn has a significant impact on children's rights, their realisation and protection. Despite the all-encompassing confusion, individuals and public authorities are obliged to take the best interests of the child as a fundamental guiding principle in the realization and protection of the child's social and economic rights. Children's social and economic rights are protected at international, regional and national levels. At international level, the Convention on the Rights of the Child is of particular relevance, as it has led to a change of focus from the protection of the child to the protection of his or her rights. Children's social and economic rights are characterised as rights of positive status, which means that a certain degree of state action is required to enforce them, and the same applies to their protection. Whatever their nature, however, parents are primarily responsible for their realisation. They must always have in mind the child's best interests and well-being. Only if this is not satisfactorily achieved by the primary providers responsible for guaranteeing the child's rights will come to the fore the various measures of parental care and State intervention. Despite the wide range of regulation, there may still be some open questions or areas that need to be explored and addressed.
