Abstract
Z razvojem reproduktivnih tehnologij so se pojavile alternativne konfiguracije družine. Novi koncepti spreminjajo definicijo starševstva in zahtevajo odmik od ustaljenih izhodišč, ki datirajo če iz časa Rimskega cesarstva. Pravne domneve, ki so stoletja ostajale trdne, kot obzidje Koloseja, so padle pod težo novih reproduktivnih tehnologij. Že Heraklit iz Efeza je dejal: »edina konstanta v življenju so spremembe.« Tehnike asistirane reprodukcije so povzročile naraščanje števila posameznikov, ki so vključeni v proces prokreacije. Gre za darovalce in prejemnike spolnih celic, nadomestne matere in nenazadnje tudi otroke, ki so rojeni s pomočjo tehnologije. Obstoj družbe brez pravil ni mogoč in nastane šele takrat, ko je vzpostavljen ustrezen normativni okvir. Iz tega sledi, da je nujna sinergija med dosežki in možnostmi, ki jih ponuja medicina in pravom, ki naj zariše normativni okvir in poda odgovor v primeru nejasnosti in dilem.

The development of reproductive technologies has given rise to alternative family configurations. These new concepts are reshaping the definition of parenthood and necessitate a departure from established paradigms dating back to the time of the Roman Empire. Legal presumptions, which stood strong for centuries like the walls of the Colosseum, have yielded to the proposition of new reproductive technologies. As Heraclitus of Ephesus famously stated, "change is the only constant in life." Assisted reproductive techniques have resulted in an increase in the number of individuals involved in the procreation process. This includes donors and recipients of gametes, surrogate mothers, and ultimately, children born with the assistance of technology. The existence of a society without rules is not tenable and only arises when an appropriate normative framework is established. From this follows the necessity for synergy between the accomplishments and possibilities offered by medicine and law, which should provide answers in times of ambiguity and dilemmas. |
