Abstract
V magistrski nalogi smo se ukvarjali z iskanjem povezave med osebnostnimi motnjami in storilci kaznivih dejanj. Cilj zaključnega dela je bil odgovoriti na raziskovalno vprašanje, ki smo si ga zastavi že v samem naslovu »Ali obstaja povezava med storilci kaznivih dejanj in osebnostnimi motnjami?« Osebnost je zgrajena iz osebnostnih značilnosti posameznika, ki se izoblikujejo že v otroštvu, nato pa se izoblikujejo skozi celotno življenje posameznika. Kadar pa so osebnostne značilnosti take, da povzročajo določene motnje v obnašanju, doživljanju in čustvovanju posameznika, govorimo o osebnostnih motnjah. Osebnostne motnje so tako nespremenljive osebnostne poteze pri ljudeh, ki povzročajo težave pri njihovem razmišljanju, čustvovanju in vedenju v interakciji z ostalimi. V priročniku DSM-V, izdanem s strani Ameriškega združenja psihiatrov, najdemo razlikovanje desetih osebnostnih motenj, uvrščenih v tri skupine A, B in C. Vsaka izmed motenj ima svoje specifične značilnosti zaradi česar so nekateri ljudje bolj podvrženi k nasilnemu in deviantnemu vedenju kot drugi. Kadar taki posamezniki storijo kaznivo dejanje, jim lahko zaradi osebnostne motnje pripišejo status neprištevnega storilca, kar pomeni, da bo njihova kazen odslužena na posebnem oddelku za prestajanje kazni – oddelku za forenzično psihiatrijo. Kazensko odgovornost in institut neprištevnosti podrobno ureja slovenski Kazenski zakonik. S pomočjo intervjuja z vodjo enote za forenzično psihiatrijo UKC Maribor, dr. Miranom Pustoslemškom in z podrobno analizo že opravljenih raziskav glede prevalence osebnostnih motenj med zaporsko populacijo v različnih državah, smo ugotovili, da obstaja povezava med antisocialno osebnostno motnjo in povečanim tveganjem za storitev kaznivega dejanja. Prav tako obstajajo povezave z mejno, narcisistično in paranoidno osebnostno motnjo in storitvijo kaznivega dejanja. Tveganje za storitev in ponovitvena nevarnost pa sta še večji, če obstajajo druga pridružena stanja kot so zloraba substanc, psihoze, shizofrenija in negativni vplivi okolja.

The aim of the thesis was to answer the research question that we had set ourselves in the title “Does connection between personality disorders and perpetrators of crimes exist?". Personality is constructed from the personality characteristics of an individual, which are formed in childhood and then continue to be shaped throughout an individual's life. However, when personality traits are such that they cause certain disturbances in the way a person behaves, experiences and feels, we speak about personality disorders. Personality disorders are thus unchangeable personality traits in people that cause difficulties in the way they think, feel and behave in their interactions with others. The DSM-V, published by the American Psychiatric Association, distinguishes ten personality disorders, classified into three groups A, B and C. Each of the disorders has its own specific characteristics, making some people more prone to violent and deviant behaviour than others. When such individuals commit a crime, they may be classified as insane because of their personality disorder, which means that their sentence will be served in a special punishment unit - a forensic psychiatric ward. Criminal liability and the institute of insanity are regulated in detail by the Slovenian Criminal Code. Through an interview with Dr. Miran Pustoslemšek, Head of the Forensic Psychiatry Unit at the UKC Maribor, and a detailed analysis of research articles already conducted on the prevalence of personality disorders among the prison population in various countries, we have established that there is a link between antisocial personality disorder and an increased risk of committing a crime. There are also associations with borderline, narcissistic and paranoid personality disorder and offending. The risk of offending and reoffending is even higher when there are other associated conditions such as substance abuse, psychosis, schizophrenia and negative environmental influences. |
