Abstract

Slovenska policija ima pomembno vlogo pri vzpostavljanju reda v državi in zagotavljanju varnosti njenih prebivalcev. Da bi svoje delo opravila na najučinkovitejši način, mora včasih uporabiti prisilna sredstva. Prisilna sredstva spadajo pod policijska pooblastila, kar pomeni, da so to ukrepi, ki jih policist izvaja na podlagi zakona. Temeljni zakon oziroma podlaga za uporabo policijskih pooblastil je Zakon o nalogah in pooblastilih policije (»ZNPPol«, 2013), kjer je med drugim navedenih tudi vseh 12 prisilnih sredstev, ki jih uporablja slovenska policija. Z njimi policisti opravljajo različna pooblastila pod zakonsko določenimi pogoji. Poleg tega, da imamo zakonsko opredeljena prisilna sredstva, je v ZNPPol določeno, pod katerimi pogoji se smejo uporabiti. Prisilna sredstva policija uporabi v različnih okoliščinah in se lahko uporabijo proti eni ali več osebam. Z uporabo prisilnih sredstev policisti posegajo v svobodo osebe in tudi v njihovo življenje, zato je ključnega pomena, da so policisti ustrezno usposobljeni za uporabo policijskih pooblastil. Poleg zakonskih pravil postopka uporabe posameznega prisilnega sredstva in usposobljenosti policisti izvajajo postopke po določenih načelih. Do večje pozornosti, namenjene uporabi prisilnih sredstev s strani policije, je prišlo med letoma 2020 in 2022, ko so potekali tako imenovani protesti proti covidnim ukrepom, na katerih je prišlo do uporabe različnih prisilnih sredstev, tako proti množici kot proti posameznikom. V medijih in na televiziji se je veliko razpravljalo o strokovni in zakoniti uporabi prisilnih sredstev, kar je povzročilo zaskrbljenost prebivalcev o pravičnosti njihove uporabe. Zato smo se v našem diplomskem delu osredotočili na mnenje prebivalcev Iga o uporabi prisilnih sredstev.

Secondary abstract: The Slovenian police has an important role in establishing order in the country and ensuring the safety of its residents. In order to do their work in the most efficient way, they sometimes have to use coercive means. Coercive means fall under police powers, which means that they are reinforcements that the police officer carries out on the basis of the law. The fundamental or the basis for the use of police powers is Police Tasks and Powers Act (Zakon o nalogah in pooblastilih policije, 2013), which, among other things, lists all 12 means of coercion used by the Slovenian police. With them, police officers exercise various powers under the conditions set by law. In addition to the fact that we have legally defined coercive means, the Police Tasks And Powers specifies the conditions under which they may be used. Coercive means are used by the police in various circumstances and can be used against one or more persons. By using coercive means, police officers encroach on a person`s freedom and also on their life, so it is crucial that police officers are properly trained to use police powers. In addition to the legal rules for the procedure for the use of individual coercive means and qualifications, police officers carry out procedures according to certain principles, since by using coercive means, police officers do not want to intentionally injure people, but to ensure that any bad act is prevented or stoped. Greater attention to the use of coercive means by the police came between 2020 and 2022, when the so-called protests against Covid measures, where various coercive measures were used, both against the crowd and individuals. There has been a lot of discussion in the media and television about the professional and legal use of coercive means, which has caused residents to worry about the fairness of their use. Therefore, in our thesis, we focused on the opinion of the residents of Ig on the use of coercive means.
