Abstract

Sistem sodobnega kontinentalnega kazenskega prava za izhodišče jemlje varstvo pravnih dobrin, ki obenem nudijo tudi njegovo teoretsko osnovo. Osrednja mu je delitev na individualne in kolektivne pravne dobrine; slednje za razliko od prvih označujejo širše, manj otipljive pravne vrednote, vezane na skupnost ter njeno delovanje kot celoto. V nalogi pojav kolektivnih pravnih dobrin obravnavam iz treh vidikov. Uvodoma obravnavam temeljna vprašanja samega postopka tipizacije, torej kako pojem kolektivnih pravnih dobrin sploh opredelimo, kako med različnimi vrstami pravnih dobrin razločujemo in kakšne posledice imata pri tem dispozicija posamezne inkriminacije ter nomotehnika mešanja dobrin. Sledi obravnava temeljnih pravnodogmatičnih lastnosti obravnavanega koncepta, ki jo ustrezna tipizacijska analiza šele omogoči; identifikacija kolektivnosti dobrin predstavlja enega izmed ključnih presečišč izpeljevanja praktičnih in teoretičnih rešitev v kazenskem pravu, a povzroča mnogo težav. Na tem mestu se ukvarjam predvsem z vprašanji tipa okrnitve dobrine, vzročnostjo, izpolnjevanjem zakonskih znakov inkriminacij in protipravnostjo. Posebno pozornost namenim kumulativno-heterogeno oziroma konjunktivno vezanim pravnim dobrinam. Nazadnje pojav kolektivnih pravnih dobrin strnjeno obravnavam še skozi njegovo kriminalitetnopolitično dimenzijo. Najprej predstavim nekatere možne ugovore pretiranemu množenju kolektivnih pravnih dobrin v posebnih delih kazenskih zakonikov, nato izpostavim nekatere značilnosti dialektike individualnega in kolektivnega v kazenskem pravu ter to prevedem v simboliko teorije pravnih dobrin. Kriminalitetnopolitično obravnavo zaključim z nomotehnično kombinatoriko kazenskopravnega obvladovanja nalezljivih bolezni.

Secondary abstract: The modern continental criminal law system is based on the protection of legal goods, with the concept of legal goods also acting as its theoretical basis. Central to it is the distinction between individual and collective legal goods, which, unlike the former, refer to broader, less tangible legal values linked to the community and its functioning as a whole. In this thesis, I consider the phenomenon of collective legal goods from three perspectives. First, I present a discussion concerning the fundamental questions of the typification process: how do we define the notion of collective legal goods in the first place, how do we distinguish between different types of legal goods, and what are the implications of the statutory disposition of a criminal offence and the nomotechnic of mixed legal goods. A consideration of the fundamental doctrinal features follows, which only a proper typological analysis can enable; although the identification of the collectivity of goods is one of the key intersections for deriving practical and theoretical solutions in criminal law, it poses many difficulties. I am mainly concerned with questions regarding the type of impairment of the legal good, causality, the satisfaction of all statutary offence elements and illegality. I pay special attention to cumulative-heterogeneously or conjunctively bound legal goods. Finally, I attempt to concisely address the phenomenon of collective legal goods through its criminopolitical dimension. I first present some possible objections to the excessive proliferation of collective legal goods in specific parts of criminal codes, then I highlight some features of the dialectic of the individual and the collective in criminal law. I translate this into the symbolism of legal goods theory and, finally, carry out a nomotechnical combinatorics regarding the criminal law control of infectious diseases.
