Abstract

Zaslišanje predstavlja temelj preiskovanja, s katerim organi pregona pridobijo ključne oziroma pomembne informacije v vezi preiskovanja določenega kaznivega dejanja. Napake pravnega sistema in nezadostna izobraženost preiskovalcev so pritegnili teoretike, kateri v zadnjih letih nadobudno raziskujejo uporabo strategij in tehnik zaslišanja. Izvedene raziskave v tujih jezikih, zaradi ovir pri prevajanju in razlik v pravnem redu onemogočajo popolno zrcaljenje in prenašanje ugotovitev na slovensko prakso. Navkljub želji po boljšem razumevanju uporabi posamezne tehnike, še vedno prevladujejo teoretični zaključi, ki imajo korenine v psihologiji in njenih podvrstah. Ob pregledu in analizi literature smo ugotovili, da se vse tehnike zaslišanja najbolj razlikujejo v samem načinu pridobivanja tovrstnih informacij, ciljih ter etične sprejemljivosti. Za slovensko prakso smo z izvedbo pol strukturiranega intervjuja prišli do spoznanja, da nikjer niso zabeležene tehnike zaslišanja, katere uporabljajo slovenski preiskovalci. Ugotavljamo pa, da slovenska zakonodaja regulira katera tehnika je etično sprejemljiva in katera ne. Slovensko prakso je težko primerjati s praksami drugih držav, saj nikjer niso točno definirane katere tehnike in taktike uporabljajo slovenski preiskovalci. Že sama zakonodaja nam poda tri besedne zveze katere se med seboj ločijo v okoliščinah pridobivanja obvestil od osumljencev ter o poimenovanju zapisov ali dokumentov, kjer je postopek beležen. V prihodnje svetujemo večjo izvedbo izobraževalnih programov namenjenih specifično za uporabo taktik in tehnik zaslišanj ter ustvarjanje enotnega dokumenta v katerem bodo zapisane dovoljene tehnike zaslišanja za slovensko prakso.

Secondary title: The use of interrogation tactics and techniques in Slovenia
Secondary abstract: Law enforcement authorities obtain key or relevant information for the investigation of a specific crime through an interrogation, which is the cornerstone of an investigation. The failures of the legal system and the lack of training of investigators have attracted theoreticians who have in recent years been actively exploring the use of interrogation strategies and techniques. Research carried out in foreign languages, due to barriers to translation and differences in legal order, does not fully reflect and transfer results to Slovenian practice. While there is a desire to better understand the application of each technique, theoretical conclusions rooted in psychology and its sub-disciplines still prevail. Upon reviewing and analyzing the literature, we discovered that all interrogation techniques differ in the way they obtain information, their objectives, and their ethical acceptability. We discovered through a semi-structured interview in Slovenia that the interrogation techniques used by Slovenian investigators are not documented anywhere. We note, however, that Slovenian legislation regulates which techniques are ethically acceptable and which are not. It is difficult to compare Slovenian practice with that of other countries, as the techniques and tactics used by Slovenian investigators are not precisely defined. The legislation itself gives us three phrases that are different in the circumstances of getting information from suspects and the names of the files or documents where the procedure is recorded. In the future, we recommend that more training programmes be organised specifically on the use of interrogation tactics and techniques, and that a single document be created to set out the permitted interrogation techniques for Slovenian practice.
