Abstract
Digitalna forenzika v slovenski policiji je ena novejših nalog in opravil kriminalistične policije. Razvijati se je začela leta 2009 in se vse do zdaj razširjala, usposablja, izobražuje in nadgrajuje strojno in programsko opremo.
Opisani zakonski pogoji za začetek postopka zavarovanja in preiskave elektronskih podatkov. Prav tako je zajeto število kaznivih dejanja z katerimi se slovenska policija najpogosteje srečuje, ter o vrsti zaseženih elektronskih naprav.
Slovenska policija opravlja digitalno forenziko po temeljnih postopkih digitalne forenzike, pravnimi predpisi, načelih in metodologiji, kateri so bili sprejeti. Sloni na standardih in normativih, katerih zadostujejo, da se digitalni dokazi lahko uporabijo v pravdnih zadevah. Slovenska policija mora spoštovati načela, metodologijo in zakonske predpisi, saj le tako lahko zagotavlja verodostojnost digitalnih dokazov v pravdnih postopkih. V nasprotnem primeru privede, da so digitalni dokazi neveljavni.
Opredeljena sta oba postopka, postopek za zavarovanje elektronskih podatkov in postopek o preiskavi elektronskih podatkov. Predstavljen je tudi postopek zagotavljanja istovetnosti in integritete z pomočjo izračuna zgoščevalni vrednosti. Postopki morejo biti izvedeni strokovno, dosledno, ter opraviti jih mora za to strokovno usposobljena oseba. O vseh postopkih se sprotno sestavlja zapisnik, v katerega je potrebno vpisati opravila katera smo opravili, ter ugotovitve tekom zavarovanja ali preiskave elektronske naprave.
V prihodnosti se bo potrebno hitreje odzivati na nenehne spremembe in novosti, več vlagati v človeške vire, njihovo znanje in usposobljenost, saj se danes najde vedno več digitalnih dokazov, vendar pa so omejitve glede najdbe le teh.

Digital forensics in the Slovenian police is one of the newer tasks and duties of the criminal police. It started developing in 2009 and has been expanding, training, educating and upgrading hardware and software until now.
Described legal conditions for starting the process of securing and investigating electronic data. It also covers the number of crimes that the Slovenian police most often encounter, as well as the types of seized electronic devices.
The Slovenian police conducts digital forensics according to the basic procedures of digital forensics, legal regulations, principles and methodology that have been adopted. It relies on standards and norms that are sufficient for digital evidence to be used in litigation. The Slovenian police must respect the principles, methodology and legal regulations, as this is the only way to ensure the credibility of digital evidence in legal proceedings. Otherwise, it renders the digital evidence invalid.
Both procedures are defined, the procedure for securing electronic data and the procedure for investigating electronic data. The process of ensuring identity and integrity with the help of hash value calculation is also presented. Procedures can be carried out professionally, consistently, and must be carried out by a professionally qualified person. Minutes are drawn up on all procedures, in which it is necessary to enter the tasks we performed, as well as the findings during the securing or investigation of the electronic device.
In the future, it will be necessary to respond more quickly to constant changes and innovations, to invest more in human resources, their knowledge and training, because today more and more digital evidence is being found, but there are only limits to finding it. |
