Abstract

V diplomskem delu Izvajanje identifikacijskega postopka na javnih shodih se je preučevala zakonska podlaga javnih shodov, policijskih pooblastil, dela policije na javnih shodih ter zakonodajo tujih varnostnih organov, ki opredeljuje postopke, sorodne postopku ugotavljanja identitete in identifikacijskemu postopku. Na podlagi analize zakonskih temeljev pooblastil so v diplomskem delu obravnavana mnenja nadzornih organov o delu policije na javnih shodih pri izvajanju pooblastil ugotavljanja identitete in identifikacijskega postopka. V diplomskem delu je bilo ugotovljeno, da sta postopka ugotavljanja identitete in identifikacijski postopek ključna policijska postopka, tudi v tujih državah, s katerima policisti opravljajo večino temeljnih policijskih nalog. Zaradi tega pooblastili spremljata tudi težave v zvezi s spoštovanjem zakonskih določil pooblastil s strani policistov, ki postopke izvajata, kar je pokazala analiza poročil nadzornih organov, ki so ocenili delo policije na javnih shodih v letih 2020 in 2021. Na podlagi poročil in analize tuje zakonodaje so bili v diplomskem delu vzpostavljeni zaključki, da je potrebno v povezavi z izvajanjem pooblastil ugotavljanja identitete in identifikacijskega postopka potrebno izvesti več usposabljanj policistov za bolj zakonito delovanje policije kot tudi v smeri spoštovanja načela sorazmernosti s strani policistov, saj je iz poročil razvidno, da policija na javnih shodih postopke opravlja nesorazmerno. Pri tem je smiselno opozoriti na omejene možnosti delovanja policije v smislu preprečevanja nastanka kršitev javnega reda in miru na javnih zbiranjih kot tudi omejene možnosti za zagotavljanje varnosti udeležencev na shodih ter zmožnosti varovanja premoženja ljudi zaradi omejenih možnosti preverjanja udeležencev javnih shodov, ki se jih udeležujejo z namenom izvajanja kaznivih ravnanj na javnih shodih.

Secondary abstract: In the thesis Implementation of the identification procedure at public gatherings, the legal basis of public gatherings, police powers, police work at public gatherings and the legislation of foreign police authorities defining procedures related to the identification procedure were studied. On the basis of the analysis of the legal basis of the powers, the opinions of the supervisory authorities on the work of the police at public gatherings on exercising powers of the identification procedure were discussed in the thesis. The thesis concluded that identification procedures are key police procedures, also in foreign countries, with which police officers perform most of the basic police tasks. For this reason, the power is also accompanied by problems related to the compliance with the legal provisions of the power by the police officers who carry out the procedures, as shown by the analysis of the reports of the supervisory bodies that evaluated the work of the police at public gatherings during 2020 and 2021. On the basis of the reports and the analysis of the foreign legislation, the thesis concluded that in relation to the implementation of the power of the identification procedure, some improvements in regards to educating the police force need to be made in terms of the lawfulness of the work of the police, as well as in terms of the compliance with the principle of proportionality by the police officers due to the fact that the reports claim that the police on the field use these procedures in an unproportional way. In this context, it is worth pointing out the limited possibilities for police action in terms of preventing breaches of law and public order from occurring as it is worth pointing out the limited possibilities to enable the safety of participants of public gatherings and the safety of property due to the limited ways the police can identify individuals who engage in these gatherings with the intent of engaging in criminal conduct.
