Abstract
V predmetni magistrski nalogi bom predstavila pravne vidike krožnega gospodarstva, ob čemer bom najprej povzela definicijo koncepta, ki se mi glede na vso pregledano literaturo zdi najustreznejša. Koncept krožnega gospodarstva je ekonomski sistem, ki zamenja koncept linearnega gospodarstva z zmanjšanjem porabe virov, s ponovno uporabo, predelavo in ponovno pridobitvijo materialov v procesih proizvodnje in uporabe. Operacionalizira se na mikro ravni (med potrošniki in gospodarskimi subjekti), mezo ravni (eko – industrijski parki) in makro ravni (med mesti, regijami in državami), z namenom trajnostnega razvoja. Sprva bom predstavila sam koncept, nadaljevala z njegovim razvojem in umestitvijo v trajnostni razvoj nato pa predstavila njegove pravne vidike. Slednjega se bom lotila izhajajoč iz definicije krožnega gospodarstva ob čemer bom najprej predstavila pravne vidike krožnega gospodarstva na makro ravni. To pomeni, da bom predstavila ustrezno podlago za uporabo prava EU v Sloveniji, saj je prav EU ena izmed gonilnih sil za prehod na krožno gospodarstvo. V tem sklopu bosta torej predstavljena oba svežnja za krožno gospodarstvo in evropski zeleni dogovor. Nadaljevala bom z nekateri finančni vidiki prehoda na krožno gospodarstvo, vplivom konkurenčno pravnih predpisov na krožno gospodarstvo in zelenim javnim naročanjem, kot tudi z načinom ravnanja z odpadki. Nenazadnje bom na kratko predstavila udejanjanje krožnega gospodarstva na mezo ravni in na kratko predstavila eko – industrijske parke, ki pa se v Sloveniji sicer še ne pojavljajo. Končno bom predstavila še pravne vidike operacionalizacije krožnega gospodarstva na mikro ravni kar pomeni, vpliv krožnega gospodarstva na zakonodajo, ki ureja varovanje potrošnikov, kot tudi na zakonodajo, ki ureja delovanje gospodarskih subjektov na trgu in notranjem poslovanju prek obveznega trajnostnega poročila.

In this Master's thesis, I will present the legal aspects of the circular economy, starting with a definition of the concept, which seems to me the most appropriate in the light of all the literature reviewed. The concept of the circular economy is an economic system that replaces the concept of the linear economy by reducing the consumption of resources and by reusing, recovering and recovering materials in the processes of production and use. It is operationalised at micro level (between consumers and economic operators), meso level (eco-industrial parks) and macro level (between cities, regions and countries), with a view to sustainable development. I will first introduce the concept itself, then go on to discuss its development and its place in sustainable development, and then present its legal aspects. I will approach the latter by starting from the definition of the circular economy, first presenting the legal aspects of the circular economy at macro level. This means that I will present the relevant basis for the application of EU law in Slovenia, as the EU is one of the driving forces behind the transition to a circular economy. So, in this session, both the Circular Economy Package and the European Green Deal will be presented. I will continue with some of the financial aspects of the transition to the circular economy, the impact of competition law on the circular economy and green public procurement, as well as waste management. Last but not least, I will briefly present the implementation of the circular economy at meso level and briefly introduce eco-industrial parks, which are not yet present in Slovenia. Finally, I will present the legal aspects of the operationalisation of the circular economy at micro level, which means the impact of the circular economy on legislation governing consumer protection, as well as on legislation governing the operation of economic operators on the market and in internal business through the mandatory sustainability report. |
