Abstract

Diplomsko delo obravnava zasebna vojaška podjetja kot pravne entitete na trgu, njihov razvoj, pomen in vlogo v sodobnih konfliktih ter njihov nadaljnji razvoj, kakor tudi medsebojne razlike in enakosti med podjetji. Uvodno so raziskane pravna ureditev zasebnih vojaških podjetij na mednarodni ravni in razlike med zasebnimi vojaškimi podjetji in plačanci. Podjetja so v diplomskem delu ločena glede na državo, kjer imajo sedež. V delu sta opisana razvoj zasebnih vojaških podjetij in nacionalna pravna podlaga za njihovo delovanje izbranih državah. Za vsako podjetje sta prikazana razvoj in njihovo delovanje ter opisana glede na storitve, ki jih oziroma so jih opravljala po kategorizaciji Petersohna (2015). V delu so prikazani izbrani primeri držav, kjer so se v konfliktih uporabljala zasebna vojaška podjetja. Opisana sta njihov pomen in vpliv, tako pozitiven kot negativen. Na koncu so raziskani možni načini nadaljnjega razvoja zasebnih vojaških podjetij oziroma prihodnost vsake od treh storitev, ki jih navede Petersohn (2015). Ugotovitve so pokazale, da podjetja izvršujejo svoje storitve na različne načine in da so interesna področja zasebnih vojaških podjetij različna, saj prevladuje storitev bojevanja in varovanja. Interesi so različni tudi v lokaciji, ravno tako pa tudi namen izvajanja storitev. Zasebna vojaška podjetja ne bodo prevzela glavne vloge pri bojevanju in varovanju v konfliktnih območjih, saj so podjetja relativno omejena z opremo, infrastrukturo in vplivom, da bi lahko samostojno izvajala vojaške operacije in zaključevala sodobne konflikte, poleg tega bi taka podjetja dvignila veliko prahu v mednarodnem prostoru. Diplomsko delo odpre vrata v tematiko zasebnih vojaških podjetij in o njihovem vplivu ter omogoča nadaljnje študije na istem področju.

Secondary title: The role of private military companies in contemporary conflicts
Secondary abstract: In this thesis, we look at private military companies as legal entities on the market, their evolution, importance and role in contemporary conflicts and their further development, as well as the differences and similarities between the companies themselves. We begin by exploring the legal regulation of private military companies at the international level and the differences between private military companies and mercenaries. We have distinguished between companies according to the country in which they are established. In selected countries, we describe the development of private military companies and the national legal basis for their operation. We have illustrated the development of the selected companies and their operations, describing them in terms of the services they provide or have provided according to the categorisation by Petersohn (2015). We have presented selected examples of countries where private military companies have been used in conflict, describing their importance and impact, both positive and negative. Finally, we explore possible ways forward for the development of private military companies or the future of each of the three services listed by Petersohn (2015). We found that companies deliver their services in different ways and that the areas of interest of private military companies are diverse, with a predominance on armed combat and security services. The interests also vary by location as well as the very purpose of the service provision. Private military companies will not take a major role in armed combat and security in conflict areas, as they are relatively limited in equipment, infrastructure and influence to conduct military operations and end modern conflicts on their own and would raise a lot of dust in the international arena. The thesis opens the door to the topic of private military companies and their impact and allows for further studies in the same field.
