Abstract

Pazniki so pomemben del osebja v zaporih, saj zagotavljajo varno okolje tako za zaprte osebe kot tudi zaporske delavce. Pazniki imajo pooblastila za zagotavljanje reda in varnosti v zaporih, vključno z uporabo prisilnih sredstev, s katerimi posegajo v integriteto posameznika, proti kateremu so ta uporabljena. Pri tem upoštevajo načelo postopnosti in sorazmernosti, saj prisilna sredstva uporabljajo le v nujnih situacijah, ko na drugačen način ne morejo zagotoviti reda in varnosti, in ob spoštovanju temeljnih človekovih pravic in svoboščin. V zaključnem delu smo se osredotočili na uporabo prisilnih sredstev nad zaprtimi osebami. Na podlagi pregleda znanstvene in strokovne literature in analize statističnih podatkov o uporabi prisilnih sredstev v zaporih smo ugotovili, da je od leta 2000 do leta 2021 uporaba prisilnih sredstev paznikov v slovenskih zavodih za prestajanje kazni zapora nad zaprtimi osebami porasla. Predvsem je opazen porast uporabe telesne sile, nekoliko pa tudi sredstev za vklepanje. Ugotovili smo, da je med letoma 2000 in 2021 porasla tudi upravičenost uporabe prisilnih sredstev, medtem ko je neupravičena in nepotrebna uporaba teh upadla. Pri analiziranju statističnih podatkov letnih poročil Varuha človekovih pravic smo ugotovili, da se je število podanih pobud zaprtih oseb v obravnavanem obdobju zmanjšalo. To potrjuje, da pazniki uspešno rešujejo konfliktne situacije z metodami, ki ne zahtevajo uporabe prisilnih sredstev, ali pa je uporaba teh ustrezna.

Secondary title: Use of coercive measures upon imprisoned persons
Secondary abstract: Prison officers present an important part of prison staff, as they provide a safe environment for both prisoners and prison workers. Prison officers have powers to ensure order and security in prisons, including the use of coercive measures to interfere with the integrity of the individual against whom they are used. In doing so, they take into account the principle of gradualism and proportionality, since they use coercive means only in situations when they cannot ensure order and security in any other way, and with respect for fundamental human rights and freedoms. In the thesis, we focused on the use of coercive measures against imprisoned persons. Based on a review of scientific and professional literature and an analysis of statistical data on the use of coercive measures in prisons, we found that from 2000 to 2021, the use of coercive measures by prison officers in Slovenian prisons increased. Above all, there is a noticeable increase in the use of physical force, and to a lesser extent the use of restraints. We found that between 2000 and 2021, the justification for the use of coercive measures also increased, while the unjustified and unnecessary use of them decreased. When analyzing the statistical data of the Ombudsman's annual reports, we found that the number of initiatives given by imprisoned persons decreased during the period under review. This confirms that prison officers successfully resolve conflict situations with methods that do not require the use of coercive means, or that the use of them is appropriate.
