Abstract
Izhodišča: Zaradi težav pri ugotavljanju medicinske napake in vzročne zveze med medicinsko napako in škodo po splošnih predpisih so sodni postopki za uveljavljanje odškodnine zapleteni, dolgotrajni in povezani z znatnimi stroški za oškodovanega pacienta.
Metode: Magistrsko delo analizira in primerja v Sloveniji veljavno splošno ureditev odgovornosti,, ki se uporablja tudi za škodo, povzročeno z medicinskimi napakami, in posebne sheme nekrivdne odgovornosti za škodo pri zdravljenju, ki so jih uvedle Danska, Francija, Finska, Norveška, Nova Zelandija in Švedska, pa tudi zakonski predlog za uvedbo takšne sheme v Sloveniji. Zaradi pogostih sprememb pravnih predpisov smo uporabljali predvsem ažurirana oziroma prečiščena besedila primarnih pravnih virov v izvirniku ali prevodu.
Rezultati: Posebne sheme nekrivdne odgovornosti za škodo pri zdravljenju zagotavljajo odškodnino za izogibno škodo na podlagi merila skrbnosti izkušenega strokovnjaka in še za taksativno določene primere škod, povezanih z zdravljenjem. Odškodnina je zaradi finančne vzdržnosti sistema omejena, postopek pred specializiranimi organi je krajši in cenejši v primerjavi s sodnim.
Razprava: Predlagani slovenski zakon o nekrivdni odgovornosti države v primeru zdravljenja povzema v glavnem rešitve, ki so skupne več ureditvam nekrivdne odgovornosti v zdravstvu v drugih državah. Pri uvajanju posebnih odškodninskih shem za področje zdravstva pa je treba upoštevati tudi gospodarsko razvitost države, raven izdatkov za zdravstvo in splošne zmogljivosti zdravstvenega sistema.

Comperative legal analysis of liability for medical errors |
Secondary abstract: |
Introduction: Due to difficulties in establishing the medical error and the causal relationship between the medical error and the damage according to general regulations, legal procedures for claiming compensation are complex, lengthy and associated with significant costs for the injured patient.
Methods: The master's thesis analyzes and compares the general regulation of liability in force in Slovenia, which also applies to damage caused by medical errors, and special schemes of no-fault liability for damage in treatment introduced by Denmark, France, Finland, Norway, New Zealand and Sweden, as well as the legislative proposal for introduction of such a scheme in Slovenia. Due to frequent changes of legal regulations, mainly updated or consolidated texts of primary legal sources (in original or translation) were used.
Results: Special no-fault liability schemes for treatment damage provide compensation for avoidable damage based on the standard of care of an experienced professional and for exhaustively determined cases of damage related to the treatment. To ensure financial sustainability of the system, the compensation is limited and the procedure before specialized authorities is shorter and cheaper compared to court proceedings.
Discussion: The proposed Slovenian Act on the no-fault liability of the state in the case of treatment mainly summarizes the solutions that are common to several schemes of no-fault liability in healthcare in other countries. When introducing special compensation schemes for the healthcare sector, the economic development of the country, the level of healthcare expenditures and the general capabilities of the healthcare system must also be taken into account. |
