Abstract

V osrednjem delu magistrskega dela je narejena analiza zasebnosti delavcev in njena pravna ureditev, saj zlasti v zadnjem casu vse vec delodajalec nenehno spremlja in nadzira delavce pri njihovem delu, vcasih tudi izven delovnega casa in okolja. Glavni poudarek magistrskega dela je na preucevanju zasebnosti delavcev v povezavi z nadzorom s pomocjo umetne inteligence, ki se vse pogosteje pojavlja v delovnih razmerjih. Za izdelavo magistrskega dela sta bili uporabljeni predvsem deskriptivna metoda ter metoda analize sekundarnih podatkov, saj podatki pridobljeni iz strokovne literature in pravnih virov, ki urejajo podrocje delovnih razmerij in uporabo umetne inteligence. Ugotovitve magistrskega dela se nanasajo na vse delavce, posebna pozornost pa je namenjena javnim usluzbencem. Na podlagi preucitve pravnih aktov, ki se navezujejo na zasebnost delavcev in uporabe umetne inteligence, je bilo ugotovljeno, da je v Sloveniji na podrocju zasebnosti na delovnem mestu, zlasti pri uporabi umetne inteligence, veliko pomanjkljivosti in posledicno priloznosti za izboljsave, s katerimi bi lahko izboljsali pravno ureditev tega podrocja. Kljucna pomanjkljivost je predvsem neazurirana pravna ureditev. Vecina pravnih aktov je namrec v veljavi ze zelo dolgo in posledicno niso najbolje prilagojeni novim nacinom poseganja v delavcevo zasebnost. Tako imajo delodajalci se vec moznosti za prekomerne posege v delavcevo zasebnost, saj jim pravna ureditev tega ne preprecuje oziroma otezuje.

Secondary title: Worker`s right to privacy in the age of artifitial intelligence
Secondary abstract: Focus of this paper is the analysis of workers privacy and its legal arrangements, since recently, more and more employers constantly monitor and control workers during their work and sometimes also outside of working hours and the work environment. The emphasis of this study is workers right to privacy in connection with artificial intelligence control, that is appearing in employment relationships. For the reparation of the paper were mostly used the descriptive method and the secondary data analysis, since the data were obtained from literature and legal sources that regulate the field of labor relations and the use of artificial intelligence. The findings of the master's thesis apply to all workers, but special attention is paid to civil servants. Based on the examination of legal acts related to the workers privacy and the use of artificial intelligence, it was found that in Slovenia there are many shortcomings in the field of workplace privacy, especially in connection with the use of artificial intelligence. Consequently, there are many opportunities for improvements that could improve the legal regulation. The key shortcoming is primarily the non-updated legal regulation. Most of the legal acts have been in force for a very long time and, as a result, are not best adapted to the new ways of encroaching on workers' privacy. Thus, employers have even more opportunities for excessive interference with the employee's privacy.
