Abstract

Magistrsko diplomsko delo obravnava izzive, s katerimi se delovno pravo sooča zaradi vzpona novih oblik zaposlovanja prek digitalnih platform. V uvodnem delu je podan opis pojma platformnega dela, kjer sta podrobneje predstavljeni dve najpogostejši obliki te zaposlitve. Osrednji del naloge analizira pravno-formalno negotovost, s katero se soočajo platformni delavci, ter posledično omejen dostop do njihovih delovnopravnih pravic. Poseben poudarek je namenjen problemom, ki izhajajo iz algoritmičnega upravljanja na platformah, kot so pomanjkanje transparentnosti in izključitev delavcev iz procesov odločanja. V zaključku naloge so predlagane konkretne rešitve, ki bi lahko izboljšale pravno zaščito in delovne pogoje platformnih delavcev.

Secondary abstract: The master's thesis addresses the challenges that labor law faces due to the rise of new forms of employment through digital platforms. The introductory section defines the concept of platform work and presents two of its most common forms. The core of the thesis focuses on the legal and formal uncertainties surrounding the status of platform workers, highlighting the rights that are consequently denied to them. Additionally, it examines the issues brought about by algorithmic management on platforms, such as the lack of transparency and the exclusion of workers from decision-making processes. In the conclusion, the thesis proposes concrete solutions aimed at improving the legal protection and working conditions of platform workers.
