Abstract

Prispevek obravnava problem nedoločenosti civilnopravnih oblik neveljavnosti, ki lahko nastopijo kot posledica kršitve obveznosti mirovanja pri dodeljevanju državnih pomoči. Problem je naslovljen na ravni prava EU in na nacionalni ravni, kar odraža zasnovo decentraliziranega izvrševanja prava državnih pomoči pred nacionalnimi sodišči. Posebni ozir raziskovalnega problema predstavlja slovenska ureditev vprašanja civilnopravne neveljavnosti ukrepov nezakonite pomoči. Slovenska sodna praksa problema namreč še ni (izrecno) naslovila, v teoriji pa se zasledijo stališča, ki prvenstveno povzemajo dognanja v razvoju sodne prakse v Nemčiji. Čeprav so ta nastajala postopoma in premorejo pomembne uporabne zaključke, je treba izpostaviti, da so tudi predmet znanstvene in strokovne kritike. Prispevek zato izpostavlja pomanjkljivosti in prednosti nemškega modela ter na tej podlagi predlaga rešitev v slovenskem pravu.

Secondary title: Invalidity of formally unlawful state aid measures
Secondary abstract: The present contribution deals with the problem of determining civil law forms of invalidity for contracts negotiated in contravention of the stand-still obligation in the process of implementing state aid measures. The problem is addressed at both the supranational level (EU law) and the national level, reflecting the overall mechanism of decentralized enforcement of state aid law before national courts. A special aspect of the research problem is presented in the issue of civil law invalidity of unlawful aid measures in Slovenia. Slovenian courts have not yet (explicitly) addressed the problem; however, scholarly writing has adopted a position which generally summarizes the findings of established case law in Germany. Although the developments in German case law were built gradually and contain important and useful conclusions, it should be noted that they are also subject to scientific and professional criticism. The present contribution therefore points out the shortcomings and advantages of the German model and, on this basis, proposes a solution in Slovenian law.
