Primerjava gozdne politike Slovenije in Finske na področju posestne strukture gozdov

Abstract

S primerjalnim pregledom zakonodaj Republike Slovenije in Republike Finske želimo opozoriti na različne možnosti reševanja problema neustrezne gozdno lastniške strukture, z analizo upravnih postopkov v prometu z gozdovi pa ugotavljamo, v kolikšni meri ukrep predkupne pravice vpliva na spremembo gozdno lastniške strukture. Diplomsko delo podaja pregled zakonodaje in vladnih dokumentov, povezanih z izvajanjem gozdne politike na področju posestne strukture gozdov v obeh državah ter analizo upravnih postopkov v prometu z gozdovi v dveh Upravnih enotah v Sloveniji. Slovenski in finski pristop reševanja problema neustrezne lastniške strukture se razlikujeta, čeprav si oba prizadevata za dosego podobnih ciljev. Z analizo ugotavljamo, dasta ponudba in povpraševanje po gozdnih posestih na območju naše analize skromna. Neuspešnost slovenske politike usmerjene koncentracije zemljišč, naj bi popravile nove, dodatne omejitve prometa z gozdovi. Finska ima dobre izkušnje z izvajanjem Zakona o pravici do pridobitve kmetijskih in gozdnih zemljišč, ki je bil v veljavi do leta 1997.

Secondary abstract:	The purpose of comparative examination of the Republic of Slovenia and the Republic of Finland laws is to emphasize the various options of resolving the inadequate forest ownership structure problem. With analysis of administrativeprocedures in forest holdings trade we establish in what extent pre-rights are effecting on change in forest ownership structure. Graduation thesis provides an overview of legislation and government documents, related to the implementation of forest policies in field of forest ownership structure in both countries. It also provides the analysis of administrative procedures in forest holdings trade in two administrative units in Slovenia. Slovenian and Finnish approach of resolving the inadequate ownership structureproblem are different, although both strive to achieve similar goals.The analysis notes that supply and demand for forest properties in the area of our analysis is insufficient. Slovenian land concentration orientated policy failure should be corrected with new, additional restrictions on forestholdings trade. Finland has positive experience with implementation of the Act on the Right to Acquire Farm Land and Forest Land, which had been in force until 1997.
