Abstract
Številna evropska podjetja poslujejo prek državnih meja in zato zanje veljajo različne obveznosti. V interesu držav članic in EU-ja je, da se vzpostavijo enotni standardi in ukrepi za zaščito kritične infrastrukture in da vsaka država članica ustrezno zaščiti svojo nacionalno kritično infrastrukturo, vendar znotraj skupnega okvira, predvsem zaradi poenotenja in preglednosti ter s tem odprave velikega števila različnih metodologij in dodatnih stroškov, ki izhajajo prav iz nepreglednosti in nestandardiziranih postopkov. Države članice so namreč na podlagi ustreznih kriterijev in metodologije dolžne določiti nacionalno kritično infrastrukturo in opredeliti, katera zaradi svoje dejavnosti lahko sodi tudi v okvir evropske kritične infrastrukture. Poleg določitve kritične infrastrukture je dolžnost vsake države članice tudi razviti nacionalne programe za njeno zaščito. Vsaka lastniška/upravljavska struktura posamezne kritične infrastrukture mora imeti, poleg vodstvenih in poslovnih sposobnosti, tudi sposobnost upravljanja z varnostnimi tveganji, s katerimi lastnik/upravljavec obvladuje izredne dogodke, do katerih lahko pride na kritični infrastrukturi oziroma v njeni okolici. Z drugimi besedami to pomeni, da je pri samem organiziranju, vodenju in nadzorovanju delovanja zmogljivosti, potrebno poznavanje obvladovanja različnih možnih in dejanskih nevarnosti, ogrožanja in varnostnega tveganja kot tudi izvajanja ukrepov in aktivnosti ob neposrednem nastanku izrednega varnostnega dogodka. Vloga Slovenske vojske pri zaščiti kritične infrastrukture je, skladno z njenim poslanstvom in nalogami, bolj podporne narave oziroma njena aktivnost prihaja do izraza v precej kasnejših fazah. Glede na dejstvo, da so ključni dejavniki zaščite kritične infrastrukture njeni lastniki/upravljavci s svojimi zmogljivostmi, torej predvsem civilno okolje, to posledično pomeni, da Slovenska vojska trenutno ne iz pravnega kakor tudi ne iz operativnega vidika ne predstavlja ključnega dejavnika zaščite kritične infrastrukture.

Many European companies operating across national borders and therefore are subject to different obligations. In the interest of Member States and the EU is to establish uniform standards and measures for the protection of critical infrastructure in each Member State to adequately protect the national critical infrastructure, but within a common framework, in particular with a view to uniformity and transparency, and the elimination of the large number of different methodologies and additional costs arising from the right and the lack of standardized procedures. Member States are, on the basis of relevant criteria and methodologies are obliged to establish a national critical infrastructure, and identify which, because of their activities may also fall within the framework of European critical infrastructure. In addition to the determination of critical infrastructure is the duty of each Member State to develop national programs to protect. Each ownership / management structure of critical infrastructure must, in addition to managerial and business skills, the ability of managing the security risks to the owner / operator is controlled by the extraordinary events which may occur in the vicinity of, or critical infrastructure. In other words, this means that, in the organizing, managing and controlling the operation of facilities, the required knowledge of the various management and real dangers, threats and security risks as well as the implementation of measures and activities at the direct emergence of the extraordinary security event. The role of the Slovenian Armed Forces in the protection of critical infrastructure, is consistent with its mission and priorities, more support of nature and its activity is embodied in much later stages. Given the fact that the key to the protection of critical infrastructure owners / operators with their capacity, thus in particular the civil environment, this means that the current Slovenian army, not from a legal as well as from an operational point of view, does not constitute a key element of critical infrastructure protection. |
