Abstract

Pravo okolja je v zadnjih desetletjih postalo eno izmed referenčnih pravnih področjih. Pravo okolja je urejeno v različnih pravnih virih. Temelje značilnosti izhajajo že iz Ustave Republike Slovenije [Ustava RS] (1991, 1997, 2000, 2003, 2004, 2006), ki v tem pogledu spada med modernejše ustave tako v Evropi kot tudi v svetu. Ustava RS (1991, 1997, 2000, 2003, 2004, 2006) opredeljuje, da je ena izmed nalog države tudi skrb za zdravo življenjsko okolje. Prav tako se na varstvo okolja nanašajo različni zakoni med katerimi imata poseben pomen Zakon o varstvu okolja [ZVO-UPB1] (2006, 2008, 2009, 2012) in Zakon o ohranjanju narave [ZON] (2004). Številne značilnosti prava okolja izhajajo tudi iz mednarodnih pravnih predpisov, kateri zavezujejo tudi Republiko Slovenijo. Varstvo okolja je temeljnega pomena tudi v Evropski uniji (v nadaljevanju EU), ki prevzema vedno večjo (odločilno) vlogo pri varovanju in izboljšanju stanja okolja. Tako je okoljska politika EU v zadnjih desetletjih prispevala k harmonizaciji okoljskega prava in k izboljšanju stanja okolja v Evropi in tudi Sloveniji. Dobra okoljska zakonodaja prispeva k učinkovitem varstvu okolja in je nujna predpostavka za uspešno reševanje okoljskih problemov. Kljub temu bo v prihodnje za učinkovito reševanje številnih okoljskih problemov potrebno povečati okoljsko zavest ter spremeniti vrednostno strukturo, ki ne bo več temeljila na pridobivanju nepotrebnih in hitro pokvarljivih materialnih dobrin, s katerimi, kot se je izrazil Ošlaj (2005), postmoderni homo faber poskuša zakriti njegovo stopnjujočo duhovno (kulturno) revščino, s čimer je doseženo, da že dlje časa prisotna patologija duha ne more izbruhniti v pandemijo.

Secondary abstract: In recent decades environmental law has become a reference area of law. Environmental Protection Law is regulated by different legal sources. The basic characteristics of the Environmental law are resulting from the Constitution of the Republic of Slovenia (1991, 1997, 2000, 2003, 2004, 2006), which is in this view a modern constitution in Europe and in the World. The Constitution of the Republic of Slovenia (1991, 1997, 2000, 2003, 2004, 2006) defines that, one of the tasks of the state is to promote a healthy living environment. The protection of the environment is regulated with different laws, among which particular importance is to be ascribed to the Environment Protection Act [ZVO-UPB1] (2006, 2008, 2009, 2012) and the Nature Conservation Act [ZON] (2004). Many characteristics of the environmental protection are resulting from international legal rules. Protecting the environment is of fundamental importance in the European Union, which increasingly assumes a crucial role in protecting and improving the condition of the environment. The European Union environmental policy in recent decades has contributed to the harmonization of environmental law and contributes to a high level of environmental protection. Good environmental legislation contributes to the effective protection of the environment. It is also a necessary prerequisite for the successful solution of environmental problems. In the future, however, it will be necessary to increase environmental awareness. A change of the value structure is to be pursued, which no longer will be based on acquiring unnecessary material and perishable goods. By pursuing such priorities, in the words of Ošlaj (2005), postmodern homo faber is trying to cover its escalating spiritual (cultural) poverty, which prevents that a long time present pathology of the spirit can not erupt into a pandemic.
