Abstract

Diplomsko delo obravnava poglavitne razlike med gradbeno in podjemno pogodbo. Gradbena pogodba je vrsta podjemne pogodbe. Ker njen obseg presega zahtevnost in obseg del pri podjemni pogodbi, jo ureja posebno poglavje obligacijskega zakonika. Za primere, ko pravila gradbene pogodbe določenega razmerja ne urejajo, se uporabijo pravila o podjemni pogodbi. Materijo gradbene pogodbe urejajo tudi drugi predpisi kot so Posebne gradbene uzance, Zakon o graditvi objektov (ZGO-1), ipd. Gradbena pogodba je podvrsta podjemne pogodbe, zato se pri določenih delih in v nekaterih okoliščinah lahko zgodi, da pride do dileme, katera pravna pravila uporabiti. V primeru, da pride spor pred sodišče, se celo tekom sodnega postopka lahko zgodi, da nižje sodišče uporabi pravila podjemne pogodbe, takšno odločitev pa višje sodišče kasneje razveljavi in razmerje podredi pravilom gradbene pogodbe. Določena pravila pri gradbeni pogodbi zakon ureja povsem drugače kot pri podjemni, posledično je za naročnika in izvajalca izjemnega pomena, katerim pravilom bo sodišče razmerje podredilo. Posledice so lahko v tem, kako dolgo bo izvajalec jamčil za opravljeno delo, kako in pod kakšnimi pogoji se lahko dogovorjena cena za opravljeno delo spremeni, vpliv oblike na veljavnost sklenjene pogodbe in druge.

Secondary abstract: Construction contract is a form of service contract. Because it`s complicated and the extent of work is much wider than at a service contract, it calls for a special regulation. It is regulated in it`s own chapter of our Obligation codification. In cases which are not regulated in this chapter it comes to the use of service conrtact regulations. The matter of construction contract is also regulated in several other regulations such as Special construction customs, Building act, ect. Because there is a legal correlation between both contracts, there is often a dillema which of the legal rules should be used. It is frequently the case, that during the legal process in court a lower instance decides to subject the contract to rules of one and the higher court decides for rules of the other contract. Although the rules are the same for some parts, they tend to be completely different in others. That is the main reason that it is of extreme importance which of the rules the court decides to use. The consequences of this decision can influence both parties, the client and the contractor. There are differences in duration of accountability, changes of the agreed price, the influence of ignoring the prescribed contract form on its validity and other.
