Abstract

1. julija 2013 je Republika Hrvaška postala članica EU. Z Zakonom o uveljavitvi prehodnega obdobja za zaposlovanje in delo državljanov Republike Hrvaške v Republiki Sloveniji po vstopu Republike Hrvaške v Evropsko unijo, je uvedeno dvoletno prehodno obdobje, ki Republiki Sloveniji omogoča, da uveljavlja nacionalno zakonodajo s področja zaposlovanja in dela tujcev, z namenom, da ne ogrozi normalnega delovanja slovenskega trga dela oz. da daje domačim brezposelnim osebam in osebam, ki so glede pravic do zaposlitve izenačene z državljani Republike Slovenije, prednostno zaposlovanje. Hrvaški delavci se v Republiki Sloveniji še naprej zaposlujejo in delajo kot državljani tretje države. Če se želijo zakonito zaposliti, še naprej potrebujejo delovno dovoljenje. Kljub temu, je članstvo v Evropski uniji prineslo nekatere spremembe za hrvaške državljane. V diplomskem delu je navedeno, za katere oblike zaposlovanja oz. dela hrvaški delavec ne rabi več delovnega dovoljenja, ter na podlagi katere pravne podlage. Načelo prostega gibanja delavcev se lahko, po vstopu Hrvaške v Evropsko unijo, pod določenimi pogoji omeji za sedem let. S 1. januarjem 2015 se začnejo uporabljati nove določbe sprememb Zakona o tujcih (ZTuj-2A), pripravlja pa se tudi nov Zakon o zaposlovanju, samozaposlovanju in delu tujcev (ZZSDT), ki bi nadomestil Zakon o zaposlovanju in delu tujcev (ZZDT-1). Predlog ZZSDT uvaja, zaradi usklajevanja z Evropsko zakonodajo, enotno dovoljenje, na podlagi katerega bodo lahko tujci prebivali in delali v Republiki Sloveniji. Nadomestilo bi tako dovoljenje za prebivanje, kot dovoljenje za delo. V diplomskem delu je opredeljeno v kolikšni meri bo »nova« zakonodaja vplivala na zaposlovanje in delo hrvaških državljanov.

Secondary abstract: On 1 July 2013 Croatia became a member of the EU. By means of the Act on Enforcement of Transitional Period for the Employment and Work of the Citizens of the Republic of Croatia in the Republic of Slovenia after the Republic of Croatia has become a member of the EU, a two-year transitional period has been implemented, allowing the Republic of Slovenia to adopt the national legislation in the field of employment and work of foreign citizens; the purpose of this being that the normal function of the Slovenian labour market should not be jeopardized, and to enable employment priority for the unemployed citizens or the people who have equal rights with regard to the employment as the citizens of the Republic of Slovenia, respectively. Croatian workers can still take up employment and work in the Republic of Slovenia as third-country citizens. If they want legal employment, they still need a work permit. Nevertheless, membership in the UE has brought some changes to the Croatian citizens. The diploma paper states which forms of employment or work do not require a work permit for a Croatian worker, and on what legal grounds. After Croatia has entered the EU, the principle of free movement of workers can on certain conditions be limited for the duration of seven years. From 1 January 2015 on, new provisions of the changes to the Aliens Act (ZTuj-2A) shall be used; also, a new Act on Employment, Self-employment and Work of Aliens (ZZSDT) is being prepared, scheduled to replace the Act on Employment and Work of Aliens (ZZDT-1). The draft of ZZDT due to the harmonization with the European legislation introduces a uniorm permit, on the basis of which foreign citizens will be able to live and work in the Republic of Slovenia. This permit would replace the residence permit as well as the work permit. The diploma paper defines to what extent the “new“ legislation will influence the employment and work of Croatian citizens.
