diplomsko delo visokošolskega strokovnega študija Organizacija in management delovnih procesov
Abstract
V diplomskem delu smo se ukvarjali s pogodbami o zaposlitvi in oblikami del in jih primerjali med sabo ter ugotavljali prednosti in slabosti posameznih pogodbenih razmerij in oblik del pri obeh pogodbenih strankah. Z vsakim novo sprejetim zakonom, ki ureja področje dela, se pravice delavca znižujejo. Pogodbeno razmerje za nedoločen čas in pogodbeno razmerje s poslovodnimi osebami, prokuristi in vodilnimi delavci še vedno daje zaposlenemu največ pravic in ugodnosti iz delovnega razmerja in s tem tudi najvišjo stopnjo socialne varnosti, navkljub temu da ZDR-1 zmanjšuje nekatere pravice in ugodnosti delavca v delovnem razmerju (odpovedni rok, odpravnina, čakanje na delo, potni stroški). Delo za določen čas in agencijsko delo ter študentsko delo pa predstavljata negotove oblike dela. Tukaj gre predvsem za kratkoročne zaposlitve, s katerimi si predvsem mladi ne morejo načrtovati varne prihodnosti, družine, zato bi se v Sloveniji morale vzpodbujati predvsem zaposlitve za nedoločen čas. Podjemna pogodba ima širok spekter uporabe, zato lahko preko podjemne pogodbe opravljajo delo tako redno zaposleni kot študenti in pa tudi upokojenci. Podjemna pogodba ima veliko prednosti in nekaj pomanjkljivosti. Za upokojenca je boljša oblika zaposlitve kot pogodba o začasnih in občasnih delih, ki vsebuje veliko omejitev tako za delavca kot tudi za delodajalca.

In diploma work we were dealing with employment contracts and ways of working and we compared them between themselves. Also we were finding out about advantages and disadvantages of certain employment contracts and ways of working with both contract clients. With every new accepted law which covers certain working field rights declines. Employment contract for indefinite time and contract relation with managers, clerks authorized to sign and leading managers still means most rights and benifits for employee and according to that highest level of social safety, even though ZDR-1 reduces some rights and benifits for employees (time specified for giving notice, indemnity money, redundancy problems, fees). Working for indefinite time, agent working and student working means uncertain ways of working. With short durations working ways young people can not plan safe future, family life, so in Slovenia above all we should encourage contracts for indefinite time. Working contract has wide range of use for reguilarly empoloyed people, students and pensioners also. Working contract has a lot of advantages and some disadvantages and it is better for pensioners than contract for temporary and part time jobs which includes a lot of limitations for both, employee and employer, but above all for employee. |
