Abstract
V diplomski nalogi smo obravnavali različne načine odpovedi pogodbe o zaposlitvi javnih uslužbencev in jih primerjali z ureditvijo v gospodarstvu. Položaj javnih uslužbencev urejata dva temeljna zakona: Zakon o delovnih razmerjih in Zakon o javnih uslužbencih. Ugotovili smo, da se za javne uslužbence v celoti uporablja ureditev iz splošne delovne zakonodaje le za postopek izredne odpovedi in za odpoved pogodbe o zaposlitvi iz krivdnega razloga. Pri ostalih načinih odpovedi obstajajo izjeme zaradi posebnega položaja javnih uslužbencev, ki jih je potrebno upoštevati pri postopkih podajanja odpovedi pogodb o zaposlitvi javnih uslužbencev. Primerjali smo tudi pravice javnih uslužbencev v primerjavi s pravicami zaposlenih v zasebnem sektorju ter ugotovili, da so pravice javnih uslužbencev dobro varovane. Izjema velja pri odpovedi pogodbe o zaposlitvi zaradi razloga nesposobnosti, kjer javni uslužbenci niso upravičeni do odpravnine. V zaključnem delu diplomskega dela smo primerjali dosedanje ukrepe Vlade Republike Slovenije za zmanjšanje javnofinančnega primanjkljaja in ugotovili, da je zaposlitev v javni upravi še vedno relativno varna, ker se odpoved zaposlitve iz poslovnega razloga zelo redko uporablja. Število javnih uslužbencev, zaposlenih v javnem sektorju, še vedno narašča (z izjemo javnih uslužbencev v državni upravi), zmanjšanje števila uslužbencev pa poteka preko mehkih metod, predvsem s pomočjo upokojevanja in nepodaljšanjem pogodb o zaposlitvi za določen čas.

The purpose of this thesis is to evaluate different grounds for termination of employment in public administration. We will compare typical and untypical termination of employment and their consequences for civil servants rights. Termination of employment in public administration is regulated by our Labor Relations Law and Civil Servants Act. Labor Relations Law is our primary national legal source for Labor affairs; however, Civil Servant Act is perhaps even more important for accurate understanding of civil servants rights and procedures, because it governs common principles and other common issues relating to the civil servants system. In this thesis we will address key differences in the termination of employment between civil servants and employees from the private sector. The goal of the amendment to the Civil Servants act from December 2005 was to equate as much as possible the rights of civil servants compared to workers from private sector. In the terms of termination of employment this goal was not achieved. There are still key differences that differentiate the position of civil servant in comparison to private sector employees. For example, civil servants do not have the same rights compared to private sector workers, because they are not entitled to severance pay when their employment is terminated due to their inefficiency. Finally, we will address the impact of current financial crisis on employment in public administration. |
