meja med zakonsko dopustnim in kaznivim vedenjem

Abstract

Uvodoma sta predstavljena spolnost in spolno dogajanje z opisom psihoseksualnih procesov, spolnega vedenja, nenavadnega spolnega vedenja, spolnih motenj in spolnih deviacij ali parafilij. Zadnje poglavje seksualnega sadizma in mazohizma obsega kazensko-pravno obravnavo s pojasnitvijo nekaterih pravnih pojmov, slovenske, britanske in ameriške zakonodaje ter opisom primerov sodnih obravnav.

Secondary abstract: The main purpose of this work is to define terms sexual sadism and masochism, and to establish boundaries between legal and illegal behaviour. At the very beginning, we intruduced human sexuality and sexual occurences with a description of psychosexual processes, sexual behaviour, unusual sexual behaviour, sexual disorders and sexual deviations/paraphilias. The paper continues with a general defitnition of sexual deviations, etiology and treatment, and then describes each paraphilia separately by using the classification of the American Psychiatric Association. Paraphilias described in this section are frotteurism, fetishism, exhibitionism, pedophilia, sexual masochism, sexual sadism, voyeurism, transvestic fetishism and other deviations. The following chapter consists of detailed description of sexual sadism and masochism. Because they most often occur together as sadomasochism, we initially defined the characteristics of this diverse sexual role-play, and then proceeded to the description of both individual sexual deviations. Sexual sadism occurs autonomously in the form of a lust murder or erotophonophilia, necrophilia, sadistic rape, various other sadistic attacks on a woman or an animal, as well as in the form of fantasies, which never come to action. Sexual masochism alone represents infliction of pain to yourself, mostly in a form of auto-erotic asphyxiation, which stands for intentional restriction of oxygen to the brain. Further etiological theories are presented, based on the psihoanalysis, physiology, behaviourism, and cognitive behaviourism, as well as sociology. The treatment of the two deviations is rare. Experts use a variety of techniques, from pharmacological medication, psychotherapy and aversive therapies. The last chapter of sexual sadism and masochism provides insight into the criminal law by clarifying certain legal concepts, Slovenian, British and American legislation and a description of the case hearings.
