Abstract
Povzetek
Diplomska naloga obravnava specifiko policijskega reševanja konfliktov med člani romske skupnosti, ki je kljub stoletnemu bivanju v »getih« na Slovenskem ohranila določeno, širši družbi nesprejemljivo obliko reševanja konfliktov s krvnim maščevanjem. Policija je kljub temu, da ji zakonodaja tega strogo ne predpisuje, začela izvajati mediacije v konfliktih, v katerih so bili prepoznani elementi krvnega maščevanja. To obliko alternativnega reševanja konfliktov izvaja kot preventivno aktivnost z namenom vplivati na samozaščitno obnašanje in ravnanje, zlasti v zvezi z osebno varnostjo in varnostjo njihovega premoženja. Gre za specifično obliko preventivne aktivnosti, ki še ni definirana, saj vključuje tako elemente sprave po Kanunu kot tudi elemente mediacije. Dejstvo je, da policisti niso usposobljeni za izvedbo mediacije. Nekateri policisti, dobri poznavalci navedene problematike, so si upali izvesti mediacijo in so bili pri tem zelo uspešni. Težava, ki jo zaznavam, je v tem, da policisti pogosto ne prepoznajo elementov krvnega maščevanja in se zato ob konfliktih odzovejo zgolj strogo represivno v zakonsko določenih okvirjih. Ti pa v specifični romski skupnosti ne zadostujejo oz. ne rešujejo konfliktov. V diplomski nalogi tako obravnavam specifiko romske skupnosti, posebnosti krvnega maščevanja in mediacijo v teoriji in praksi z namenom, da bi predstavil svoje izkušnje in spodbudil tiste policiste, ki si želijo takšnega trajnega reševanja konfliktov, pa bodisi nimajo zadostnega znanja bodisi za to ne zberejo dovolj poguma. Dejstvo je, da Romi kot specifična skupnost želijo najhujše spore reševati s pomočjo pomiritvenih – mediacijskih postopkov, težava pa je največkrat v tem, da ne vedo, na koga naj se v takih primerih obrnejo.

Summary - Mediation - an effective way to resolve conflicts among the Roma
The thesis discusses the specifics of police conflict solving among member of the Roma community, which has despite of the century long living in “ghettos” in Slovenia preserved a certain, to the wider society unacceptable form of conflict solving through vendetta. The police started to carry out mediations in conflict situations, where elements of vendetta have been recognized, despite of the fact that the legislation does not strictly order them. This form of alternative conflict solving is carried out as a preventive activity in order to influence the self-protective behaviour and actions, especially in connection with personal safety and safety of their assets. It is a specific form of preventive activity, which is still undefined, since it includes elements of reconciliation according to Kanun as well as mediation elements. Fact is that policemen are not trained to carry out mediation. Some policemen, who are very familiar with the issue, have dared to carry out the mediation and were very successful at it. The problem, I am sensing regarding this issue is that policemen often do not recognize elements of vendetta and therefore in conflict situations act strictly repressive within a legally defined framework. These, however, are not sufficient in the specific Roma community or do not solve conflicts. The thesis, thus, discusses the specifics of the Roma community, peculiarities of vendetta and mediation in theory and practice, in order to present my own experience and encourage those policemen, who want to participate in such long-lasting solving of conflicts, but lack the needed knowledge or are not courageous enough. Fact is that the Roma as a specific community want to solve the worst conflicts through calming – mediation procedures, but the problem is most times in the fact that they do not know, who to consult in such cases. |
